fa جراحی ارتوپدی و مسؤولیت های ناشی از آن در نظام حقوقی ایران <div align="justify" style="direction: rtl">مسؤولیت پزشکی نیز مانند هر مسؤولیت دیگری مشتمل بر مسؤولیت مدنی و جزائی است. ماهیت اعمال پزشکی به گونه ای است که احتمال وقوع خسارت در آن امری اجتناب ناپذیر است. تمامی بیماران حق دارند از پزشکان انتظار درمان طبی استاندارد داشته باشند. اما این بدان معنی نیست که پزشکان باید نتیجه درمانی رضایت بخش را برای بیماران تضمین کنند چرا که دخالت عوامل متعدد ممکن است، نتیجه نهایی و قابل پیش بینی درمان را عوض کند؛ لذا عدم نتیجه گیری مطلوب در درمان یک بیمار ضرورتاً به معنی قصور پزشک نیست. متخصص ارتوپدی به مداوای بیماران دچار بیماری های استخوان، مفاصل و ستون فقرات می پردازد. این بیماری ها شامل شکستگی ها و دررفتگی ها، فلج های مادرزادی و اکتسابی، ترمیم زردپی ها و اعصاب محیطی و درمان تومورهای استخوانی می باشند. اما این مسؤولیت سنگین مستلزم خطراتی برای پزشکان و نیز بیماران است؛ لذا بررسی مبنای تقصیر و شرایط تحقق مسؤولیت کیفری جراح ارتوپد با تحول حقوقی در مفهوم مسؤولیت پزشکی در قانون مجازات اسلامی مصوب 1931 حائز اهمیت و موضوع بحث این مقاله است</div> <div align="justify">The Medical liability like any other liability includes civil and criminal liabilities. The nature of medical practices is so that the possibility of the occurrence of damage is unavoidable therein. All the patients have the right to expect a standard medical treatment from the physicians. But, this does not mean that the physicians should guarantee for the patients a satisfactory treatment result, since the involvement of various factors may change the final and foreseeable result of the treatment therefore not obtaining a desired result in the treatment of patients does not necessarily mean the physicians&rsquo; faults. The orthopedist deals with the treatment of the patients suffering from diseases of the bones, joints and the spinal column. These diseases include fractures, luxations, congenital and acquired paralyses, repair of tendons and peripheral nerves and treatment of bone tumors.
