fa مطالعه تطبیقی مسئولیت مدنی صغار و بیماران روانی؛ در جستجوی یک نظریه پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:2;"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">زمینه و هدف:</span></span></b> <span lang="AR-SA">با نگاه از زاویه‌ای متفاوت، سخن از مسئولیت مدنی صغار و بیماران روانی، به واقع کاوشی است فلسفی در خصوص کیفیت تأثیر صغر سن و ضعف یا فقدان عنصر روانی ادراک در حقوق مسئولیت مدنی. در چنین پژوهشی اصولاً با دو نگرش و مبنای فکری مواجهیم.</span><span lang="FA"><span style="font-family:"B Nazanin""></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">روش:</span></span></b> <span lang="AR-SA">این تحقیق از نوع نظری بوده و روش تحقیق به صورت توصیفی ـ تحلیلی است و بر مبنای جمع‌آوری اطلاعات به صورت کتابخانه‌ای و با مراجعه به اسناد،کتب و مقالات صورت گرفته است.<span style="color:black"></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">ملاحظات اخلاقی:</span></span></b> <span lang="AR-SA">در تحقیق حاضر، اصل امانتداری، صداقت، بی‌طرفی و اصالت اثر رعایت شده است.</span><b><span lang="FA"><span style="color:maroon"></span></span></b></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">یافته‌ها:</span></span></b> <span lang="AR-SA">در یکسو نظام&rlm;های عینی&rlm;گرا (نوعی‌گرا) قرار دارند که اصولاً صغر سن یا فقدان عنصر روانی تمیز را در حقوق مسئولیت مدنی دخالت نمی&rlm;دهند، بلکه رویکرد تحلیل‌های خود را بر روابط عینی محض استوار کرده‌اند. در مقابل، اما نظام&rlm;های ذهنی&rlm;گرا (شخصی‌گرا به معنای خاص) واقع شده‌اند که به دنبال تأثیر عناصر پیچیده روانی و ذهنی بر حقوق مسئولیت مدنی و روابط طرفین دعوا هستند. این گرایش می‌کوشد با دخالت‌دادن عناصر سنی و روانی در تعدیل حداقلی یا حداکثری مسئولیت مدنی صغر و مجانین گام بردارد.</span><span lang="FA"><span style="font-family:"B Nazanin""></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">نتیجه‌گیری:</span></span></b> <span lang="AR-SA">با وجود این، به &rlm;نظر می&rlm;رسد راه&rlm; حل منطقی‌تر در اتخاذ راهکاری میانه و مختلط است، معیاری که عینی&rlm;گرایی را در کنار شخصی&rlm;گرایی بنشاند و نقطه توازنی مطلوب میان حقوق طرفین دعوا ترسیم نماید، اما بی‌گمان اتخاذ راهکار نهایی و قاطع در این دست مطالعات فلسفی ـ حقوقی دشوار است، چه چهره ملاحظات اخلاقی و ناظر به انصاف در این‌گونه مطالعات پررنگ بوده، مرزهای قاطع حقوق و اخلاق کم‌رنگ‌تر شده و به همان میزان دستیابی به عدالت واقعی دشوارتر می&rlm;گردد.</span><b><span lang="FA"><span style="font-family:"B Nazanin""></span></span></b></span></span></span></span></span><br> &nbsp;</div> <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:2;"><b><span style="color:maroon">Background and Aim:</span></b> Looking at it from a different angle, talking about the civil responsibility of minors and mentally ill people is actually a philosophical exploration regarding the quality of the influence of young age and the weakness or lack of the psychological element of perception in civil liability rights.<span style="font-family:"Times New Roman","serif""></span><br> <b><span style="color:maroon">Method:</span></b> This research is of a theoretical type and the research method is descriptive-analytical and <span style="letter-spacing:-.1pt">the method of collecting information is library-based and by referring to documents, books and articles.</span><br> <span style="background:#f7f7f7"><b><span lang="EN"><span style="color:maroon">Ethical Considerations:</span></span></b> In this research, the principles of trustworthiness, honesty, neutrality and originality of the work have been respected.<span style="color:black"></span></span><br> <span style="background:#f7f7f7"><b><span style="color:maroon">Results:</span></b> In this kind of research, we are basically faced with two attitudes and intellectual bases: on the one hand, there are objectivist systems that do not involve young age or the lack of a clean psychological element in the rights of civil liability, but the analysis approach They have based themselves on purely objective relationships. On the other hand, there are subjective systems (individualistic in a special sense) that look for the influence of complex psychological and mental elements on the rights of civil responsibility and the relations of the litigants.<span style="color:black"></span></span><br> <b><span style="color:maroon">Conclusion:</span></b><b> </b>This tendency tries to take a step by involving the age and psychological elements in the minimum or maximum adjustment of the civil responsibility of minors and minors. Despite this, it seems that a more logical solution is to adopt middle and mixed approach, a criterion that puts objectivity next to personalism and draws a favorable balance point between the rights of the parties to the dispute.
