fa حقوق بیماران به عنوان مصرف‌کنندگان تجهیزات پزشکی (مطالعه تطبیقی حقوق ایران و اسناد اتحادیه اروپا) <p>پیشرفت و توسعه اقتصادی همراه با پیچیده‌تر شدن تکنولوژی ساخت انواع لوازم و تجهیزات پزشکی در چند دهه گذشته به خصوص در سال‌های اخیر، موجب شده است که قشر عظیم &laquo;بیماران&raquo; در مقابل گروهی دیگر به نام &laquo;تولید‌کنندگان و عرضه‌کنندگان لوازم و تجهیزات پزشکی&raquo;، قرار بگیرند. در این میان، حمایت از بیمارانی که از یک طرف ناگزیر از مصرف کالاهای طبی و پزشکی مشخصی هستند و از طرف دیگر غالباً با حقوق خود آشنایی کافی ندارند و چه‌بسا تحت‌تأثیر تبلیغات تولید‌کنندگان این کالاها مغبون واقع می‌شوند، ایجاب می‌کند که پس از مفهوم‌شناسی و تبیین جایگاه حقوق بیمار به عنوان مصرف‌ـ کننده تجهیزات پزشکی، موضوع حقوق حمایتی وی را از زوایای مختلف بررسی کرده و ساختار معینی برای آن ترسیم کنیم. امروزه در اکثر کشورهای دنیا از جمله ایران، حقوقی برای بیماران به رسمیت شناخته شده است. مهم‌ترین این حقوق حمایتی زمانی که به بیمار به عنوان مصرف‌کننده‌ تجهیزات پزشکی بنگریم؛ عبارتند از: حق آزادی در انتخاب، حق دسترسی به اطلاعات، حق آموزش، حق برخورداری از محصول سالم و ایمن و حق دسترسی به مراجع حل اختلاف. مطالعه و بررسی این حقوق و مباحث مرتبط با آن می‌تواند ضمن راهنمایی و کمک به قشر عظیم بیماران جهت استیفای کامل حقوقشان، کیفیت و کارایی تولید لوازم و تجهیزات طبی و پزشکی را در کشور ارتقاء بخشد. تطبیق مباحث با حقوق کشورهای پیشرفته و صنعتی دنیا از جمله اتحادیه اروپا که در زمینه حمایت از بیمار در سال‌های گذشته پیشگام بوده است، مخصوصاً در جهت یافتن خلاءهای موجود در حقوق داخلی، کمک قابل توجهی خواهد نمود.</p> <p>The survivals of the human generation and his health are dependent on benefit from a healthy environment and having various animal species. Animals are the most important part of ecology which their rights have been concentrated by the environmental defense more than any other creatures. Making adequate provision of water and food, verifiable biological and psychological conditions and the need for access to healthcare are the most important animal rights. On the one hand, by the local law, the constitution of the Islamic Republic of Iran relies on the environmental protection as a public duty, on the other hand, not only the chapter VI of the civil law approved in 1304 dedicated to hunting, but also consideration is given to the protection of animal species by the criminal law requirements under the provision of the acts 679 and 680. There, in the realm of international law, approximately half a century ago, in the field of environmental protection and animal rights, several international documents have been concluded.
