fa تحلیلی بر توسعه حقوقی سلامت انسان، حیوان و گیاه با تأکید بر توافق‌نامه اقدامات بهداشتی و بهداشت گیاهی (SPS) پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:2;"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA"><span style="color:maroon">زمینه و هدف:</span></span></b> <span lang="AR-SA">توافق‌نامه بهداشتی و بهداشت گیاهی (</span><span dir="LTR">SPS</span><span lang="AR-SA">) ناظر بر مقرراتی است که هدفش حمایت از سلامت بشری، حیوانی و گیاهی است. امروزه در نظام بین‌الملل بسیاری از دولت‌ها مقرراتی برای تضمین سلامت غذای مصرف‌کنندگان و پیشگیری از شیوع آفات یا بیماری‌ها در میان حیوانات و گیاهان وضع شده است. این تدابیر بهداشتی (سلامت انسانی و حیوانات) و فیتوسنیتری (سلامت گیاهان) در قالب تعهدات بین‌المللی زمینه‌های حفاظت را تا حدودی مرتفع ساخته است، اما چالش‌های پیش روی اجراهای مؤثر ضمانت‌ها، منجر به عدم پایبندی به تعهدات بین‌المللی در اشکال مختلف آن شده است که می‌تواند سلامت بشری را مورد تهدید قرار دهد.</span><span lang="FA"><span style="font-family:&quot;B Nazanin&quot;"></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA"><span style="color:maroon">روش:</span></span></b><span lang="AR-SA"> این تحقیق از نوع نظری بوده و روش تحقیق به صورت توصیفی ـ تحلیلی است و بر مبنای جمع‌آوری اطلاعات به صورت کتابخانه‌ای و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.</span><b><span lang="AR-SA"><span style="color:maroon"></span></span></b></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA"><span style="color:maroon">ملاحظات اخلاقی:</span></span></b><span lang="FA"> در تحقیق حاضر، اصل امانتداری، صداقت، بی‌طرفی و اصالت اثر رعایت شده است.</span><span lang="AR-SA"><span style="font-family:&quot;B Nazanin&quot;"></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA"><span style="color:maroon">یافته‌ها:</span></span></b> <span lang="FA">در رابطه با مقررات مرتبط با بهداشت و سلامت، موافقت‌نامه موانع فنی (</span><span dir="LTR">Conservation of Natural Habitates</span><span lang="FA">) فرا روی تجارت، جای خود را به موافقت‌نامه اقدامات بهداشتی و بهداشت گیاهی (</span><span dir="LTR">SPS</span><span lang="FA">) داده، این موافقت‌نامه، شرایط اعمال استانداردهای را برای تعیین میزان احتمال وقوع خطر برای سلامت انسان، حیوان و گیاه تدوین کرده است. در این مقاله به بررسی دقیق اقدامات صورت‌گرفته در موافقت‌نامه </span><span dir="LTR">SPS</span> می‌پردازیم.<span lang="AR-SA"><span style="font-family:&quot;B Nazanin&quot;"></span></span></span></span><br> <b><span dir="RTL" lang="AR-SA"><span style="color:maroon">نتیجه‌گیری:</span></span></b><span dir="RTL" lang="FA"> هدف این موافقت‌نامه ایجاد چارچوبی از قواعد و اصول لازم به منظور توسعه، تصویب و اجرای اقدامات بهداشتی و بهداشت گیاهی است تا از این طریق، آثار منفی بر تجارت را کاهش دهد. از جمله این اشکال می‌توان به الزام در واردات محصولات از منطقه عاری از بیماری‌ها، بازرسی محصولات، بررسی ویژه یا فرآوری محصولات، تعیین حداکثر سطوح مجاز از ته‌مانده‌های آفت‌کش‌ها یا استفاده مجاز از مواد اضافه‌کردنی خاص در غذا یاد کرد.</span></span></span></span></div> <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:2;"><b><span style="color:maroon">Background and Aim:</span></b> The Sanitary and Phytosanitary Agreement (SPS) govern regulations aimed at protecting human, animal and plant health. Today, in the international system of many governments, regulations have been established to ensure the health of consumers&#39; food and to prevent the spread of pests or diseases among animals and plants. This health (human and animal health) and phytosanitary (plant health) measures in the form of international commitments have raised the protection areas to some extent, but the challenges facing the effective implementation of guarantees lead to non-compliance with international commitments in It has various forms that can threaten human health.<span style="font-family:&quot;Times New Roman&quot;,&quot;serif&quot;"></span><br> <b><span style="color:maroon">Method:</span></b> This research is of a theoretical type and the research method is descriptive-analytical and the method of collecting information is library-based and by referring to documents, books and articles.<br> <span style="background:#f7f7f7"><b><span lang="EN"><span style="color:maroon">Ethical Considerations: </span></span></b><span lang="EN">In this research, the principles of trustworthiness, honesty, neutrality and originality of the work have been respected.</span><span style="color:black"></span></span><br> <span style="background:#f7f7f7"><b><span style="color:maroon">Results:</span></b><span lang="EN"> In relation to regulations related to health and safety, the Agreement on Technical Barriers (Conservation of Natural Habitats) over trade has been replaced by the Agreement on Sanitary and Phytosanitary Measures (SPS). The occurrence of danger for human, animal and plant health has been compiled. In this article, we will examine the measures taken in the SPS agreement.</span><span style="color:black"></span></span><br> <b><span style="color:maroon">Conclusion:</span></b> The purpose of this agreement is to create a framework of rules and principles necessary to develop, approve and implement sanitary and phytosanitary measures in order to reduce the negative effects on trade.
