fa حمایت از حیوانات در قوانین ایران و اسناد بین‌المللی <p>بقای نسل انسان و سلامتی او در گروی بهره‌مندی از محیط زیست سالم و برخوردار از گونه‌های متنوع جانداران است. حیوانات از مهم‌ترین زیست‌بوم‌هایی‌اند که حقوق آنها بیش از هر موجود دیگری توجه مدافعان زیست‌محیطی را به خود جلب کرده است. تدارک آب و خوراک مناسب، شرایط زیستی و روانی صحیح و لزوم دسترسی به بهداشت و درمان از جمله مهم‌ترین حقوق حیوانات به شمار می‌رود. در حقوق داخلی از یک‌سو قانون اساسی جمهوری اسلامی ایران، حفاظت از محیط زیست را یک وظیفه همگانی می‌داند و از سوی دیگر نه تنها باب ششم قانون مدنی مصوب 1304، به شکار اختصاص یافته, بلکه مقررات حقوق کیفری نیز حفاظت از گونه‌های جانوری را در مواد 679 و 680 قانون مجازات اسلامی به طور خاص مورد توجه قرار داده است. آن سوتر در عرصه حقوق بین‌الملل از حدود نیم قرن قبل، اسناد بین‌المللی متعددی در زمینه حفاظت از محیط زیست و حمایت از حقوق حیوانات منعقد شده است. این نوشتار می‌کوشد موضع نظام حقوقی ایران در حمایت از حیوانات را با تکیه بر اسناد بین‌المللی مرتبط با حقوق محیط زیست بررسی و برای رفع موانع راهکارهایی را مطرح نماید.</p> <p>The survivals of the human generation and his health are dependent on benefit from a healthy environment and having various animal species. Animals are the most important part of ecology which their rights have been concentrated by the environmental defense more than any other creatures. Making adequate provision of water and food, verifiable biological and psychological conditions and the need for access to healthcare are the most important animal rights. On the one hand, by the local law, the constitution of the Islamic Republic of Iran relies on the environmental protection as a public duty, on the other hand, not only the chapter VI of the civil law approved in 1304 dedicated to hunting, but also consideration is given to the protection of animal species by the criminal law requirements under the provision of the acts 679 and 680. There, in the realm of international law, approximately half a century ago, in the field of environmental protection and animal rights, several international documents have been concluded.
