fa آثار حقوقی رویکردهای جهاد با تکیه بر مبانی فقهی در حکومت اسلامی پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:2;"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">زمینه و هدف:</span></span></b> <span lang="AR-SA">پدیده جنگ با تاریخ حیات بشر پیوند داشته و همواره با دیدگاه‌های سیاسی، اقتصادی، جغرافیایی و روان‌شناختی همراه بوده و هست. جنگ با همه تلخی‌ها و ناملایماتش می‌تواند روی دیگری هم داشته باشد و آن زمانی است که از مشروعیت آن سخن گفته شود.</span> <span lang="AR-SA">آنگاه که سرزمینی مورد تهاجم قرار گرفته و ناخواسته متحمل درد و رنج جنگ شده، ضمن آنکه خود را با امکانات همه‌جانبه تجهیز می‌کند، در پی حقوق از دست‌رفته خود نیز می‌باشد. از این جهت، جنگ اجتناب‌ناپذیر می‌تواند به صفحه ماندگار تاریخ تبدیل شود.</span><span lang="FA"><span style="font-family:&quot;B Nazanin&quot;"></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">روش:</span></span></b> <span lang="AR-SA">این تحقیق از نوع نظری بوده و روش تحقیق به صورت توصیفی ـ تحلیلی است و بر مبنای جمع‌آوری اطلاعات به صورت کتابخانه‌ای و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.<span style="color:black"></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">ملاحظات اخلاقی:</span></span></b> <span lang="AR-SA">در تحقیق حاضر، اصل امانتداری، صداقت، بی‌طرفی و اصالت اثر رعایت شده است.<span style="font-family:&quot;B Nazanin&quot;"></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">یافته‌ها:</span></span></b> <span lang="AR-SA">جهاد از جمله احکام و تکالیفی است که با شرایط و ضوابط و مقررات خاص و دقیق خود، فرد مسلمان مکلف را بر آن می‌دارد تا از جان مال ارض و عرض جامعه اسلامی دفاع کند. جهاد روش دفاعی سازمان‌یافته‌ای است که شریعت برای جامعه اسلامی در برابر تهدیدات ترسیم می‌نماید.<span style="font-family:&quot;B Nazanin&quot;"></span></span></span></span><br> <b><span dir="RTL" lang="FA"><span style="color:maroon">نتیجه‌گیری:</span></span></b> <span dir="RTL" lang="AR-SA">جهاد متأثر از عقیده و باورهای دینی است. تقسیم‌بندی جهاد و تبیین جهاد ابتدایی و احکام آن و بررسی این مهم در عصر غیبت و فقدان ظاهری امام معصوم (ع) و نیز نقش فقیه در این راستا رسالت صفحات پیش رو در این نوشتار است.</span></span></span></span></div> <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:2;"><b><span style="color:maroon">Background and Aim:</span></b> The phenomenon of war is connected with the history of human life and has always been associated with political, economic, geographical and psychological perspectives. War with all its bitterness and misfortunes can have another side and that is the time to talk about its legitimacy. When a land is invaded and unwillingly suffers the pain and suffering of war, while equipping itself with all-round facilities, it is also looking for its lost rights. From this point of view, inevitable war can become a permanent page, become history.<span style="font-family:&quot;Times New Roman&quot;,&quot;serif&quot;"></span><br> <b><span style="color:maroon">Method:</span></b> This research is of a theoretical type and the research method is descriptive-analytical and the method of collecting information is library-based and by referring to documents, books and articles.<br> <span style="background:#f7f7f7"><b><span lang="EN"><span style="color:maroon">Ethical Considerations:</span></span></b> In this research, the principles of trustworthiness, honesty, neutrality and originality of the work have been respected.<span style="color:black"></span></span><br> <span style="background:#f7f7f7"><b><span style="color:maroon">Results:</span></b> Jihad is one of the rules and obligations that, with its specific and precise conditions and regulations, obligates the Muslim person to defend the life, property, land and width of the Islamic society.
