fa بررسی پوشش‌های بیمه‌ای زیان‌دیدگان سوانح هوایی با مطالعه تکالیف و مسئولیت‌های بیمه‌گر با تأکید بر حقوق سلامت آسیب‌دیدگان Examining the Insurance Coverage of Air Accident Victims by Studying the Duties and Responsibilities of the Insurer with an Emphasis on Health Rights پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: شرکت بیمه بسته به پوشش بیمه‌ای که برای مسافران در نظر گرفته است، بر تعداد مسافران، غرامت پرداخت می‌کند. بیمه هواپیما شامل بیمه بدنه هواپیما، بیمه سرنشینان، بیمه اموال و بیمه افرادی است که در محل سقوط هواپیما دچار خسارت شده‌اند. روش: این تحقیق از نوع نظری بوده و روش تحقیق به صورت توصیفی ـ تحلیلی است و بر مبنای جمع‌آوری اطلاعات به صورت کتابخانه‌ای و با مراجعه به اسناد، کتب و مقالات صورت گرفته است. ملاحظات اخلاقی: در تحقیق حاضر، اصل امانتداری، صداقت، بی‌طرفی و اصالت اثر رعایت شده است. یافته‌ها: یافته‌ها نشان می‌دهد در ارتباط با بحث سوانح هوایی، در داخل کشور و سایر کشورها تعارض قوانین در حمل و نقل بین‌المللی سبب عدم یکپارچگی درتفسیر قوانین و در جاهایی نیز سوءاستفاده شرکت‌های بیمه در تعهدات خود در حمل و نقل بین‌المللی شده است و این واقعیت که شکاف‌هایی در رویه‌های پرداخت خسارت و غرامت به مسافرین، درگذشتگان و... از سوی شرکت‌های بیمه در کشورهای مختلف وجود دارد و بسیاری از مردم مناطق و کشورها را تحت تأثیر قرار می‌دهد. نتیجه‌گیری: ماده ۱ قانون تعیین حدود مسئولیت شرکت‌های هواپیمایی ایرانی مصوب ۱۳۹۱ بیان می‌دارد که در پروازهای داخلی در مورد حمل و نقل مسافران فقط مطابق قانون مجازات اسلامی عمل می‌شود. بنا بر ماده فوق مسئولیت شرکت هواپیمایی در قبال مسافران مطابق با قانون مجازات اسلامی تعیین می‌گردد، در نتیجه مسئولیت شرکت هواپیمایی و تعیین جبران خسارت بر اساس قانون دیات مندرج در قانون مجازات اسلامی مانند سایر قتل‌های شبه‌عمد و یا خطایی از سوی قاضی دادگاه تعیین می‌شود.</div> <div style="text-align: justify;">Background and Aim: The insurance company pays compensation on the number of passengers depending on the insurance coverage it has considered for the passengers. Airplane insurance includes airplane body insurance, passenger insurance, property insurance and insurance for people who suffered damage at the place of the plane crash Method: This research is of a theoretical type and the research method is descriptive-analytical and the method of collecting information is library-based and by referring to documents, books and articles Ethical Considerations: In this research, the principles of trustworthiness, honesty, neutrality and originality of the work have been respected. Results: The findings show that in connection with the discussion of air accidents, in the country and other countries, the conflict of laws in international transportation has caused a lack of integrity in the interpretation of laws and in some places, the abuse of insurance companies in their obligations in international transportation and this The fact that there are gaps in the procedures for paying damages and compensation to passengers, deceased, etc. by insurance companies in different countries affects many people in regions and countries. Conclusion: Article 1 of the law on determining the limits of responsibility of Iranian airlines approved in 2011 states that in domestic flights, the transportation of passengers can only be carried out in accordance with the Islamic Penal Code. According to the above article, the responsibility of the airline company towards passengers is determined in accordance with the Islamic Penal Code. As a result, the responsibility of the airline company and the determination of damages are determined based on the law of diyat contained in the Islamic Penal Code, like other intentional or accidental murders, by the court judge.
