fa همسرآزاری روحی و روانی ناشی از تدوام زوجیت ناخواسته، مصادیق و مبانی ممنوعیت آن از منظر فقه امامیه پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:2;"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">زمینه و هدف:</span></span></b> <span lang="FA">واژه همسرآزاری، برخلاف اینکه در اذهان عموم به عنوان آزار و اذیت شوهر علیه زن به کار می&rlm;رود، به صورت آزار زن علیه شوهر نیز موضوعیت می‌یابد. همسرآزاری روحی و روانی در نتیجه زوجیت ناخواسته، از گونه‌های همسرآزاری است که از سوی هر یک از زوجین، قابل تصور می‌باشد. پژوهش حاضر، با هدف تبیین همسرآزاری روحی و روانی ناشی از تدوام زوجیت ناخواسته و مصادیق و مبانی ممنوعیت آن از منظر فقه امامیه، به بررسی و تحلیل می‌پردازد.<span style="font-family:"B Nazanin""></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">روش:</span></span></b> <span lang="FA">این تحقیق از نوع نظری بوده و روش تحقیق به صورت توصیفی ـ تحلیلی است و روش جمع‌آوری اطلاعات به صورت کتابخانه‌ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.<span style="font-family:"B Nazanin""></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">ملاحظات اخلاقی:</span></span></b> <span lang="FA">در تحقیق حاضر، اصل امانتداری، صداقت، بی‌طرفی و اصالت اثر رعایت شده است.</span><span lang="FA" style="border: 1pt none windowtext; padding: 0in;"><span style="background:white"><span style="font-family:"B Nazanin""></span></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">یافته‌ها:</span></span></b> <span lang="FA">همسرآزاری روحی و روانی، به عنوان مهم‌ترین پدیده زوجیت ناخواسته، به اشکال مختلفی از سوی هر یک از زن و شوهر واقع می‌گردد.</span><b><span lang="FA"><span style="font-family:"B Nazanin""></span></span></b></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">نتیجه‌گیری:</span></span></b> <span lang="FA">آیاتی از قرآن، از جمله آیه 6 سوره طلاق و 19 سوره نساء به دلالت التزامی، دال بر ممنوعیت همسرآزاری روحی و روانی می‌باشد، از سوی دیگر، آزار روحی و روانی هر یک از زوجین نسبت به دیگری، غالباً با نوعی عسر و حرج و ورود ضرر همراه است که مستند به قواعد نفی عسر و حرج، معاشرت به معروف و لاضرر، ممنوع می‌باشد.</span><b><span lang="FA"><span style="font-family:"B Nazanin""></span></span></b></span></span></span></span></span><br> &nbsp;</div> <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:2;"><span style="background:#f7f7f7"><b><span style="color:maroon">Background and Aim:</span></b> The term wife abuse, contrary to the fact that it is used in the public&#39;s mind as the husband&#39;s harassment against the wife; it is also used as the wife&#39;s harassment against the husband. Spousal abuse as a result of unwanted marriage is one of the types of spousal abuse that can be imagined by any couple. The present research aims to explain the emotional and psychological abuse of the spouse caused by the continuation of unwanted marriage and the examples and bases of its prohibition from the perspective of Imami jurisprudence.</span><br> <b><span style="color:maroon">Methods:</span></b> This research is of a theoretical type and the research method is descriptive-analytical and the method of collecting information is library-based and was done by referring to documents, books and articles.<br> <span style="background:#f7f7f7"><b><span style="color:maroon">Ethical Considerations:</span></b> In this research, the principles of trustworthiness, honesty, neutrality and originality of the work have been respected.</span><br> <span style="background:#f7f7f7"><b><span style="color:maroon">Results:</span></b><b> </b>Mental and emotional spousal abuse, as the most important phenomenon of unwanted marriage, occurs in different ways by each husband and wife.<span style="background:white"><span style="color:black"></span></span></span><br> <span style="background:#f7f7f7"><b><span style="color:maroon">Conclusion:</span></b><b> </b>Verses from the Quran, including verse 6 of Surah Talaq and 19 of Surah Nisa, implying commitment, indicate the prohibition of mental and emotional abuse of spouses, on the other hand, mental and emotional abuse of each spouse towards the other, often with There is a kind of difficulty and embarrassment and the introduction of harm, which is based on the rules of negation of difficulty and embarrassment, associating with the famous and harmless is prohibited.</span><br> <br> <b>Please cite this article as:</b><br> Fadaee Z, Molai Kandlos F.
