fa مسئولیت مدنی داروخانه و مسئول فنی داروخانه در قبال سلامت شهروندان پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:2;"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">زمینه و هدف:</span></span></b> <span lang="FA">دارو یکی از اقلام مصرفی در درمان شهروندان است که هرگونه خطا در مصرف آن می‌تواند آثار زیانباری به دنبال داشته باشد. بر همین اساس هدف مقاله حاضر بررسی مسئولیت مدنی داروخانه و مسئول فنی داروخانه در قبال سلامت شهروندان است.</span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">روش:</span></span></b> <span lang="AR-SA">مقاله مورد اشاره توصیفی ـ تحلیلی بوده و از روش کتابخانه‌ای استفاده‌ شده است.</span><span lang="FA"><span style="color:black"></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">ملاحظات اخلاقی:</span></span></b> <span lang="AR-SA">در تمام مراحل نگارش پژوهش حاضر، اصالت متون، صداقت و امانتداری رعایت شده است.</span><span lang="FA"><span style="color:black"></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">یافته‌ها:</span></span></b> <span lang="AR-SA">دکتر داروساز به عنوان مسئول فنی در داروخانه، ضامن جبران ضرر وارده به بیماران می‌باشد. مسئولیت ناشی از نسخه‌پیچی و فرآیندهای مرتبط با تهیه، توزیع و تحویل دارو به بیماران طبق مقررات و ضوابط بهداشتی و درمانی، توجه به اصالت داروها، توانایی در ترکیب داروها، بررسی عوارض، تداخل دارویی و دادن مشاوره به پزشکان و بیماران، ارائه کالاهای بهداشتی و درمانی از مصادیق مسئولیت داروخانه و مسئول فنی داروخانه به شمار می‌آید.</span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">نتیجه‌گیری:</span></span></b> <span lang="AR-SA">در حقوق ایران<b>، </b></span><span lang="FA">داروخانه و مسئول فنی داروخانه تنها در صورت ارتکاب تقصیر، مسئول جبران خسارت ناشی از فرآورده ‌های دارویی می‌باشند، البته تقصیر بایستی فاحش باشد و خطاهای کوچک مسئولیت‌آور نیستند، ضمن اینکه نشانه‌هایی از مسئولیت محض نیز به عنوان مبنای مسئولیت مدنی</span> <span lang="FA">داروخانه و مسئول فنی داروخانه در قبال سلامت شهروندان وجود دارد.</span><span lang="AR-SA"><span style="font-family:&quot;B Nazanin&quot;"></span></span></span></span></span></span></span><br> &nbsp;</div> <div><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:2;"><span style="background:#f7f7f7"><b><span style="color:maroon">Background and Aim:</span></b> Medicine is one of the consumable items in the treatment of citizens and any error in its use can have harmful effects. Responsibilities arising from prescriptions and processes related to preparation, distribution and delivery of drugs to patients according to health and medical regulations and rules, paying attention to the authenticity of drugs, ability to combine drugs, checking side effects, drug interactions and giving advice to doctors and patients. Health and medical products are examples of the responsibility of the pharmacy and the technical manager of the pharmacy.</span><br> <span style="color:black"><b><span style="color:maroon">Conclusion:</span></b><b> </b>In Iranian law, the pharmacy and the technical manager of the pharmacy are only responsible for compensation for the damage caused by the medicinal products in case of fault. Of course, the fault should be gross and small mistakes; They are not responsible.
