fa حق دادخواهی افراد توانخواه و سالمند در فرایند دادرسی (با تأکید بر دستورالعمل قوه‌ قضاییه مصوب سال ۱۴۰۲) پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">زمینه و هدف:</span></span></b> <span lang="AR-DZ"><span style="color:black">هدف از این تحقیق شناسایی حق دادخواهی افراد توانخواه و سالمند در فرایند دادرسی و تطبیق آن با معیارهای حقوق بشری مندرج در اسناد بین‌المللی اعلامیه جهانی حقوق بشر، از جمله کنوانسیون حمایت از حقوق معلولین مصوب سال </span></span><span lang="FA"><span style="color:black">۲۰۰۶</span></span> <span lang="AR-DZ"><span style="color:black">و بیان سیاست‌ها و راهبردهای قوانین داخلی اخیرالتصویب به ‌منظور ارائه راهکارها و پیشنهادهای کاربردی در جهت رفع خلأهای قانونی مربوط در قوانین و تقریب بیشتر آن با معیارهای حقوق بشری است</span></span><span lang="AR-SA"><span style="color:black">.</span></span><b><span lang="FA" style="font-family:"B Nazanin""></span></b></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">روش:</span></span></b> <span lang="AR-DZ"><span style="color:black">این مقاله از نظر هدف کاربردی و از نظر روش توصیفی ـ تحلیلی است. گردآوری اطلاعات با استفاده از منابع کتابخانه‌ای و اینترنتی می‌باشد که مباحث نظری و نتایج به صورت توصیفی ـ تحلیلی ارائه شده است</span></span><span lang="AR-SA"><span style="color:black">.</span></span><span lang="FA"><span style="color:black"></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">ملاحظات اخلاقی:</span></span></b> <span lang="AR-DZ">در پژوهش‌حاضر، جنبه‌های اخلاقی مطالعه کتابخانه‌ای شامل اصالت متون، صداقت و امانتداری رعایت شده است</span><span lang="AR-SA">.</span><b><span lang="FA"><span style="color:black"></span></span></b></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">یافته‌ها:</span></span></b> <span lang="AR-DZ">یافته‌های این نوشتار بیانگر این واقعیت است که حمایت از معلولین، متأثر از تحولات حقوق بشری و دستاوردهای حقوق تطبیقی در قوانین اخیرالتصویب بیشتر مورد اهتمام واقع شده و با پیش‌بینی یا ارتقای ابعاد مختلف حقوقی، گام‌های مؤثری در جهت توسعه حقوق معلولین برداشته شده است، به‌گونه‌ای که می‌توان زین پس آن را جزء جدایی‌ناپذیر فرایند رسیدگی به حقوق آن‌ها محسوب کرد</span><span lang="AR-SA">.</span><span lang="FA"><span style="color:black"></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">نتیجه‌گیری:</span></span></b> <span lang="AR-DZ">برآیند نهایی از این نوشتار این است که علیرغم تلاش‌ها در جهت تقریب قوانین با معیارهای جهانی حقوق بشری، به دلیل پایین‌بودن میزان و کیفیت شاخص‌های سرمایه اجتماعی در ارتباط با بسترمندسازی قوانین، امکان دارد اجرای سیاست‌های حمایتی در این حوزه با چالش‌های جدی مواجه شود. از این ‌رو اجرای بهینه سیاست‌های برابرسازی افراد توانخواه با سایرین نیازمند ارزیابی و تحلیل دقیق نتایج تدوین سیاست‌ها در عرصه عمل و ارتقای کارآمدی سیاست‌ها و راهبردهای حمایتی به نحو مقتضی است</span><span lang="AR-SA">.</span><span dir="LTR" style="font-family:"Times New Roman",serif"></span></span></span></span></span></span><br> &nbsp;</div> <div style="text-align: justify;"><span style="font-family:Tahoma;"><span style="font-size:12px;"><span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%"><span style="color:maroon">Background and Aim:</span></span></b> <span style="line-height:115%">The purpose of this research is to identify the right to access justice for persons with disabilities and the elderly in the legal process and to align it with human rights standards set forth in international documents such as the Convention on the Rights of Persons with Disabilities adopted in 2006 and to express policies and strategies of domestic laws in order to provide practical solutions and suggestions to address legal gaps and to bring it closer to human rights standards.</span><span style="line-height:115%"><span style="font-family:"Times New Roman",serif"></span></span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%"><span style="color:maroon">Method:</span></span></b> <span style="line-height:115%">This article is both practically and descriptively analytical in terms of method; information is collected using library and internet sources and the theoretical discussions and results are presented descriptively and analytically.</span><span style="line-height:115%"><span style="font-family:"Times New Roman",serif"></span></span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span lang="EN"><span style="line-height:115%"><span style="color:maroon">Ethical Considerations:</span></span></span></b> <span style="line-height:115%">In this study, ethical aspects of library research including authenticity of texts, honesty and integrity have been observed.</span><span lang="EN"><span style="line-height:115%"><span style="font-family:"Times New Roman",serif"></span></span></span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%"><span style="color:maroon">Results:</span></span></b><b> </b><span style="line-height:115%">The <span style="letter-spacing:-.1pt">findings of this paper indicate that support for persons with disabilities has become a major concern influenced by human rights developments and achievements in recent legislative enactments. Effective steps have been taken towards predicting or enhancing various legal dimensions, leading to the development of the rights of persons with disabilities, which can now be considered an integral part of the process of addressing their rights.</span></span></span></span><br> <span style="line-height:115%"><span style="color:black"><b><span style="line-height:115%"><span style="color:maroon">Conclusion:</span></span></b><b> </b><span style="line-height:115%">The final outcome of this paper is that despite efforts to align laws with global human rights standards, due to the low level and quality of social capital indicators related to law-making, implementation of supportive policies in this area may face serious challenges.
