fa نقش و جایگاه هوش مصنوعی در شهادت و کتمان آن توسط کادر درمان The Role and Place of Artificial Intelligence in Testimony and Its Concealment by the Treatment Staff پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: همچنانکه شهادت یکی از دلایل مهم اثباتی جرائم در امور حقوقی به شمار می‌رود، کتمان شهادت نیز باعث تضییع حقوق خواهد گردید و جرم علیه عدالت قضایی است که باید مورد توجه قرار گیرد؛ از سویی نیز هوش مصنوعی یک فناوری پیچیده است که با سرعت فوق‌العاده‌ای توسعه می‌یابد. این تحولات هیجان‌انگیز در مسائل حقوقی و قضایی نیز جایگاه پیدا کرده و در تعاملات افراد جامعه نقش جدی را ایفا می‌کند، لذا هدف مقاله حاضر بررسی نقش و جایگاه هوش مصنوعی در شهادت و کتمان آن توسط کادر درمان است. روش: این تحقیق از نوع نظری بوده و روش تحقیق که به صورت توصیفی ـ تحلیلی بوده، از طریق مراجعه با اسناد، کتاب‌ها و مقالات گردآوری شده است. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. یافته‌ها: بر پایه یافته‌های پژوهش، فناوری هوش مصنوعی طیف وسیعی از کاربردها در فرآیندهای قضایی را شامل می‌شود که از جمله در استماع شهادت مجازی هوشمند، هوش مصنوعی به عنوان شاهد اشاره نمود. همچنین با استفاده از تشخیص کتمان شهادت از طریق یادگیری ماشینی، تشخیص کتمان شهادت از طریق تشخیص چهره و تشخیص کتمان شهادت از طریق محاسبات وضعیت عاطفی اشاره کرد که از راهبردهای پیشگیری از کتمان شهادت محسوب می‌شوند. نتیجه‌گیری: با توجه به اینکه برای کتمان شهادت مقرره صریحی در این خصوص در قوانین کیفری وجود ندارد، به جز برخی موارد کتمان (رجوع) از شهادت که مصداق جرم شهادت دروغ است که در چنین مواردی امکان اینکه کتمان شهادت انجام پذیرد، بیشتر می‌شود، لذا پیشرفت فناوری‌های هوش مصنوعی باعث پیشگیری از کتمان شهادت می‌گردد. از سویی نیز کادر درمان با توجه به موقعیتی که در آن قرار دارند و می‌توانند در روند درمان شاهد حادثه باشند که با کتمان آن جرم علیه عدالت قضایی اتفاق می‌افتد که از مصادیق آن می‌توان به کتمان شهادت در آگاهی از سوءرفتار و قصور سایر کادر درمان و کتمان شهادت در اطلاع از بیماری اشاره نمود.  </div> <div style="text-align: justify;">Background and Aim: Also, testimony is one of the important proofs of crimes in the justice of legal affairs; Concealment of testimony will also cause violation of rights and is a crime against judicial justice that should be taken into consideration; On the other hand, artificial intelligence is a complex technology that develops at an extraordinary speed. These exciting developments have also found a place in legal and judicial issues and play a serious role in the interactions of people in the society. Therefore, the purpose of this article is to investigate the role and place of artificial intelligence in testimony and its concealment by the medical staff. Method: This research is of a theoretical type and the research method, which is descriptive-analytical, has been collected by referring to documents, books and articles. Ethical Considerations: In all stages of writing the present research, while respecting the originality of the texts, honesty and trustworthiness have been observed. Results: Based on the findings of the research, artificial intelligence technology includes a wide range of applications in judicial processes, including artificial intelligence as a witness in the hearing of intelligent virtual testimony; Also, using machine learning to detect hidden testimony, detect hidden testimony through facial recognition, and detect hidden testimony through emotional state calculations, he pointed out that these are strategies for preventing hidden testimony. Conclusion: Or note that there is no explicit regulation in this regard in the criminal laws for the concealment of testimony, except for some cases of concealment (referral) of testimony, which is an example of the crime of perjury, in such cases, the possibility of concealment of testimony is increased, so the progress Artificial intelligence technologies prevent concealment of testimony. On the other hand, the treatment staff, according to the situation they are in and can witness an incident during the treatment process, which by concealing it, a crime against judicial justice is committed, examples of which can be the concealment of testimony in the knowledge of misconduct and negligence of other treatment staff and The concealment of testimony in the knowledge of the disease mentioned.
