fa نقش رویه قضایی در توسعه حقوق پزشکی در نظام حقوقی ایران پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">زمینه و هدف:</span></span></b> <span lang="AR-SA"><span style="color:black">امروزه با توجه به پیشرفت‌های نوین پزشکی و رشد سریع آن، قانون به عنوان مهم‌ترین منبع حقوق در نظام حقوق پزشکی ایران به تنهایی قادر به مطابقت سریع خود با تحولات مذکور نبوده و نظام حقوق پزشکی در فضای امروزی با توجه به عدم تدوین قوانین و مقررات جامع و کامل، نیازمند مداخله عوامل دیگری برای ایجاد این هماهنگی می‌باشد. از میان منابع حقوقی، رویه قضایی می‌تواند این نقش را به خوبی ایفا نماید. از همین روی مقاله حاضر بر آن است تا ضمن بررسی اهمیت و ضرورت استفاده از رویه قضایی در نظام حقوق پزشکی پیشنهاداتی به منظور تقویت جایگاه رویه قضایی در توسعه حقوق پزشکی ارائه دهد.</span></span><b><span style="font-family:&quot;B Nazanin&quot;" lang="FA"></span></b></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">روش:</span></span></b> <span lang="AR-SA">این تحقیق از نوع نظری بوده و روش تحقیق به صورت توصیفی ـ تحلیلی می‌باشد. روش جمع‌آوری اطلاعات به صورت کتابخانه‌ای و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.</span><span lang="FA"><span style="color:black"></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">ملاحظات اخلاقی:</span></span></b> <span lang="AR-SA">در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.</span><b><span lang="FA"><span style="color:black"></span></span></b></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">یافته‌ها:</span></span></b> <span lang="AR-SA">نتایج بررسی پژوهش حاضر حکایت از آن دارد که هر‌چند در نظام حقوق پزشکی ایران استفاده از رویه قضایی غالبا به ‌عنوان منبع فرعی و تفسیری قانون مورد توجه بوده، لکن نقش محاکم، در بیان و تولید رویه قضایی حاوی اصول کلی و مفاهیم بنیادی حقوق پزشکی، بسیار مهم و حیاتی می‌باشد.</span><span lang="FA"><span style="color:black"></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">نتیجه‌گیری:</span></span></b> <span lang="AR-SA">نتایج بررسی حکایت از آن دارد که رویه قضایی محاکم می‌تواند به عنوان یک منبع قاعده‌ساز با تحکیم و اعتلای مفاهیم و اصول حقوق پزشکی و نیز به عنوان ابزار مکمل قانون و راهنمای مقنن در تصویب قوانین و مقررات پزشکی مترقی، نقش اساسی در پرورش و توسعه حقوق پزشکی ایفا نماید.</span><span dir="LTR" style="font-family:&quot;Times New Roman&quot;,&quot;serif&quot;"></span></span></span></span></span></span><br> &nbsp;</div> <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%"><span style="color:maroon">Background and Aim:</span></span></b> <span style="line-height:115%">Today, according to modern medical developments and its rapid growth, the law as the most important source of law in Iran&#39;s medical law system alone is not able to quickly comply with the aforementioned developments, and the medical law system in today&#39;s environment due to the lack of Compiling comprehensive and complete laws and regulations requires the intervention of other factors to create this coordination. Among the legal sources, judicial procedure can play this role well.
