fa بررسی انتقادی رویکرد اسناد و مقررات منطقه‌ای و بین‌المللی در حوزه نفی مصادیق خشونت علیه زنان پناهجو A Critical Review of the Approach of Regional and International Documents and Regulations in the Field of Denying Examples of Violence against Refugee Women پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: خشونت علیه زنان و مخصوصاً خشونت علیه زنان پناهجو، بنا به دلایل تاریخی و فرهنگی در جوامع مختلف از گذشته بازتاب و نمود داشته است و نسبت به آن نیز از همان دیرباز، واکنش‌های مختلفی نشان داده شده است. روش: این تحقیق به صورت توصیفی ـ تحلیلی تهیه و تنظیم شده است، بیشتر از رویکرد اسناد و مقررات منطقه‌ای و بین‌المللی به مصادیق خشونت علیه زنان پناهجو و مصادیق و وضعیت آن‌ها در کشورهای میزبان پرداخته است. ملاحظات اخلاقی: در تحقیق حاضر، اصل امانتداری، صداقت، بی‌طرفی و اصالت اثر رعایت شده است. یافته‌ها: یافته‌های پژوهش نشان می‌دهد که مجموعه اسناد و مقررات منطقه‌ای و بین‌المللی که توجه و تمرکز بر روی حقوق زنان و زنان پناهجو داشته‌اند، مصادیق مختلف و شناخته‌شده‌ای از خشونت علیه زنان در حوزه‌های مختلف اعم از خشونت فیزیکی، جنسی و کلامی را جرم‌انگاری کرده و با اتخاذ واکنش تقنینی، برای آن‌ها مجازات‌های کیفری وضع کرده است. همچنین تحولات اسناد و مقررات بین‌المللی در دهه‌های اخیر و همینطور تلاش برای وضع قوانین اختصاصی در حوزه زنان پناهجو و نفی خشونت علیه آن‌ها از اقدامات جدید بین‌المللی برشمرده می‌شود که نسبت به دهه‌های پیشین و عادی‌بودن خشونت علیه زنان و عدم حمایت جدی تقنینی در این حوزه، گامی رو به جلو محسوب می‌شود. نتیجه‌گیری: بررسی مصادیق خشونت علیه زنان پناهجو، نتیجتاً نشانگر این است که علیرغم وضع و تصویب قوانین متعدد منطقه‌ای و بین‌المللی، آنچه که در عرصه عمل و اجرا در خصوص تبعیض و نقض حقوق زنان پناهجو و خشونت علیه آن‌ها در کشورهای مقصد روی می‌دهد، با اهداف این اسناد و مقررات چندان سازگار نیست، امری که بازبینی مقررات بین‌المللی و وضع ضمانت اجراهای دقیق برای کشورهای میزبان را در حوزه برخورد با زنان پناهجو ضروری ساخته است.  </div> <div>Background and Aim: Violence against women and especially violence against refugee women, due to historical and cultural reasons, has been reflected in different societies in the past and various reactions have been shown to it since long ago. Method: This research has been prepared and organized in a descriptive and analytical manner, rather than the approach of regional and international documents and regulations, it has dealt with the examples of violence against refugee women and their examples and situation in the host countries. Ethical Considerations: In this research, the principles of trustworthiness, honesty, impartiality and originality of the work have been observed. Results: The findings of the research show that the set of regional and international documents and regulations that have paid attention and focus on the rights of women and refugee women have different and well-known examples of violence against women in different areas, including physical, sexual and verbal violence. has criminalized and imposed criminal punishments for them by adopting a legislative response, also the developments of international documents and regulations in recent decades as well as the attempt to establish specific laws in the field of refugee women and the denial of violence against them are among the new international measures that are compared to the previous decades and the normality of violence against women and the lack of serious legislative support in this area are considered a step forward. Conclusion: Examining the examples of violence against refugee women, as a result, shows that despite the establishment and approval of numerous regional and international laws, what is happening in the field of practice and implementation regarding the discrimination and violation of the rights of refugee women and violence against them in the destination countries the goals of these documents and regulations are not very consistent, which has made it necessary to review international regulations and establish strict implementation guarantees for host countries in the field of dealing with refugee women.
