fa بایسته‌های حق دفاع متهم؛ مقارنه اسناد بین‌المللی و نظام حقوقی ایران پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:2;"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA"><span style="color:maroon">زمینه و هدف:</span></span></b> <span lang="AR-SA">حق دفاع متهم و مساعدت به وی جهت تدارک دفاع در مقابل اتهام انتسابی از بایسته‌های دادرسی منصفانه است. این فرصت نه به عنوان امتیاز ویژه برای متهم، بلکه از باب ایجاد تعادل و توازن میان طرفین دعوا قابل توجیه است. بر این مبنا شخصی که در مظان اتهام قرار دارد، باید از حمایت دستگاه عدالت کیفری برخوردار گردد تا بتواند در جایگاهی برابر با شاکی از خود در برابر اتهام انتسابی دفاع کند. نوشتار حاضر درصدد شناسایی سازوکارهای اجرایی تضمین حق دفاع متهم در اسناد و مقرره‌های بین‌المللی و در حقوق ایران می‌باشد.</span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA"><span style="color:maroon">روش:</span></span></b><span lang="AR-SA"> پژوهش حاضر به روش توصیفی &nbsp;تحلیلی و با جمع‌آوری اطلاعات به صورت کتابخانه‌ای انجام گرفته است و درصدد است به بایسته‌های حق دفاع متهم با رویکرد مقارنه اسناد بین‌المللی و نظام حقوقی ایران بپردازد.</span><b><span lang="AR-SA"><span style="color:maroon"></span></span></b></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA"><span style="color:maroon">ملاحظات اخلاقی:</span></span></b> <span lang="AR-SA">در این مقاله ضمن رعایت اصالت متون صداقت و امانتداری رعایت شده است.<span style="font-family:&quot;B Nazanin&quot;"></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA"><span style="color:maroon">یافته‌ها:</span></span></b> <span lang="AR-SA">یافته‌های این نوشتار نشان می‌دهد، تفهیم اتهام، اعطای مهلت مناسب به متهم برای تدارک دفاعیه، حق دسترسی به اطلاعات و دریافت اطلاعات مهم‌ترین تضمینات حقوق دفاعی متهم هستند که در هم حقوق بین‌الملل و هم در حقوق ایران مورد توجه قرار گرفته‌اند.</span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA"><span style="color:maroon">نتیجه‌گیری:</span></span></b> <span lang="AR-SA">در نظم کنونی مقررات ناظر بر حق دفاع، بازنگری در موضوع اعطای &laquo;مهلت متناسب برای تدارک دفاع&raquo; و تمهید &laquo;ضمانت اجراهای حقوقی و کیفری برای حمایت از حق دفاع&raquo; ضرورت دارد.</span><b><span lang="FA"><span style="font-family:&quot;B Nazanin&quot;"></span></span></b></span></span></span></span></span><br> &nbsp;</div> <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:2;"><b><span style="color:maroon">Background and Aim:</span></b> The right to defend the accused and to assist him in preparing the defense against the imputed charge is one of the requirements of a fair trial. This opportunity can be justified not as a special privilege for the accused, but to create a balance between the parties. On this basis, the person who is accused should be supported by the criminal justice system in order to be able to defend himself against the accusation on an equal footing with the plaintiff. This article seeks to identify the executive mechanisms of guaranteeing the defendant&#39;s right to defense in international documents and regulations and in Iranian law.<br> <b><span style="color:maroon">Method:</span></b> The present research has been carried out by a descriptive-analytical method and by collecting information in a library form and it tries to address the requirements of the accused&#39;s right to defense by comparing international documents and Iran&#39;s legal system.<br> <b><span lang="EN"><span style="color:maroon">Ethical Considerations:</span></span></b> In this article, while respecting the authenticity of the texts, honesty and trustworthiness have been observed.<br> <b><span style="color:maroon">Results:</span></b> The findings of this article show that the explanation of the charge, giving the accused a suitable deadline to prepare a defense, the right to access information and receive information are the most important guarantees of the defendant&#39;s defense rights, which are considered in both international law and Iranian law.<span style="color:black"></span><br> <b><span style="color:maroon">Conclusion:</span></b><b> </b>In the current system of regulations governing the right of defense, it is necessary to review the issue of granting &quot;proportionate time to prepare defense&quot; and provide &quot;guarantee of legal and criminal executions to protect the right of defense&quot;<span style="letter-spacing:-.1pt">.</span><span style="font-family:&quot;Times New Roman&quot;,&quot;serif&quot;"></span><br> <br> <b>Please cite this article as:</b><br> Salimi Ghalei E, Bouzari S, <a href="http://ijmedicallaw.ir/search.php?slc_lang=en&sid=1&author=Malaekeh" target="_blank"><span style="text-decoration:none">Malaekeh</span></a> E.
