fa پرداخت دیه نفس به فرد مبتلا به بیماری کشنده <p>یکی از دارایی‌های انسان که ممکن است مورد تعرض دیگران واقع شود، جسم و جان اوست که البته با ارزش‌ترین دارایی انسان محسوب می‌شود و در حقوق اسلام نیز حفظ و احترام به آن شدیداً مورد توجه قرار گرفته است، تعرض به تمامیت جسمانی اشخاص از دو جنبه حقوقی و کیفری باعث ایجاد مسؤولیت می‌شود. فراهم کردن شرایط ورود میکروب به بدن افراد از این قبیل است؛ بعضی از این میکروب‌ها کشنده هستند و پس از ورود به بدن عوارضی را ایجاد نموده و پس از گذشت مدت زمانی فرد را به کام مرگ می‌کشاند. حال اگر فردی مانند پزشک، بدون سوءنیت و اطلاع، باعث آلوده‌شدن دیگری به این نوع میکروب‌ها گردد، در مقابل فرد آلوده شده تا چه میزان مسؤولیت دارد؟ از آنجایی که مبانی فقهی، فرد مبتلا به بیماری کشنده را در حکم متوفی قرار می‌دهد، این موضوع می‌تواند مستمسک خوبی در جهت صدور حکم به دیه کامل در حق زیان دیده باشد.</p> <p>One of the properties of human that is possible to be invaded by others is body and life.
