fa واکاوی نوع قرارداد انتقال خون پژوهشي Original Article <span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:1;"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">زمینه و هدف:</span></span></b> <span lang="AR-SA">طب انتقال خون به عنوان یکی از نوین‌ترین راه‌های درمانی در پزشکی مدرن در دنیا مطرح است که &laquo;خون&raquo; و &laquo;انتقال خون&raquo;، مبانی و ماهیت آن را تشکیل می‌دهند. خون انسان به عنوان یک ماده حیاتی در مقایسه با سایر اعضای بدن دارای ویژگی‌های خاص و متمایزی است و بدین‌جهت در گذشته و به خصوص امروزه مورد توجه بشر و به طور خاص مورد نظر فقها، حقوقدانان و نظام‌های حقوقی داخلی و بین‌المللی قرار گرفته، لیکن با روشن‌شدن ابعاد جدیدی از کاربردهای درمانی و دارویی آن و ابهام، اجمال و خلأ قانونی در نظام حقوقی ایران در این زمینه مشکلاتی را در پروسه انتقال خون ایجاد می‌نماید که در این تحقیق نحوه واگذاری خون ‌و اَشکال قراردادی بین انتقال‌دهنده و سازمان انتقال خون و پزشک معالج مورد واکاوی قرار گرفته است.</span><span lang="FA"><span style="font-family:&quot;B Nazanin&quot;"></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">روش:</span></span></b> <span lang="AR-SA">این تحقیق با بهره‌گیری از منابع فقهی و حقوقی به روش توصیفی ـ تحلیلی و از منابع کتابخانه‌ای نگارش یافته است.</span><span lang="FA"><span style="color:black"></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">ملاحظات اخلاقی:</span></span></b> <span lang="AR-SA">در پژوهش حاضر جنبه‌های اخلاقی مطالعه کتابخانه‌ای شامل اصالت متون، صداقت و امانتداری رعایت شده است.</span><span lang="FA"><span style="color:black"></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">یافته‌ها:</span></span></b> <span lang="AR-SA">یافته‌های تحقیق نشان می‌دهد با عنایت به ویژگی‌ها و خصوصیاتی که عقود معین و نامعین دارند، نمی‌توان قراردادهای انتقال خون را بر آن‌ها منطبق نمود و این قراردادها با توجه به خصیصه خاص آن‌ها دارای قواعد خاصی می‌باشد که به دلیل اهمیت این نوع درمان و ارتباط آن با سلامت انسان این ویژگی‌های خاص باید در قواعدگذاری مورد توجه قرار گیرد.</span><b><span lang="FA"><span style="font-family:&quot;B Nazanin&quot;"></span></span></b></span></span><br> <b><span dir="RTL" lang="FA"><span style="color:maroon">نتیجه‌گیری:</span></span></b> <span dir="RTL" lang="AR-SA">با عنایت به ماهیت خون، انتقال خون و ویژگی‌های خاص قرارداد انتقال خون و پروسه آن و خدمات خاصی که در این پروسه ارائه می‌شود، محرز شد که باید قرارداد انتقال خون در قالب یک عقد جدید و خاص دارای قانون خاص باشد و نمی‌توان آن را در قالب عقود معین و حتی نامعین توصیف نمود</span></span></span></span> <span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:1;"><span style="background:#f7f7f7"><b><span style="color:maroon">Background and Aim:</span></b> Blood transfusion medicine is considered as one of the newest treatment methods in modern medicine in the world, where &quot;blood&quot; and &quot;blood transfusion&quot; form its foundations and nature.
