fa درنگی در حکم ویرایش ژنی هسته سلول زایشی A Reflection on the Ruling of Germline Cell Nuclear Gene Editing پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: «شخصیت جسمی» به معنای حقی است که انسان بر تمامیت جسمانی خود دارد. این حق شامل ممنوعیت ایراد صدمه، ضرب و جرح و هرگونه تعرض جسمی به فرد می‌شود. یکی از تکنیک‌های نوین در علم ژنتیک، «ویرایش ژنی هسته سلول زایشی باهدف ارتقای صفات و ویژگی‌های ژنتیکی» است. لذا، این سؤال مطرح می‌شود که در نظر فقه، حکم ویرایش ژنی هسته سلول زایشی با هدف ارتقای صفات ژنتیکی چیست؟ روش: فرایندی که در این فناوری نوظهور برای ارتقای صفات ژنتیکی مانند افزایش قدرت دید، افزایش قد، هوش و... به کار می‌رود، بدین‌گونه است که از طریق لقاح خارج رحمی، یک ژن جدید، فعال و دارای ویژگی‌های برتر به درون سلول تخم تزریق می‌شود و پس از آن، رویان دست‌ورزی‌شده به رحم زن منتقل می‌شود تا تغییرات ایجادشده در ساختار و عملکرد بدن اعمال شوند. برای به دست‌آوردن حکم شرعی این فناوری نوین، از روش گردآوری اطلاعات کتابخانه‌ای و اسنادی و متد توصیفی ـ تحلیلی استفاده شده است. ملاحظات اخلاقی: نویسندگان در تمامی مراحل نگارش پژوهش، اصالت متون، صداقت و امانتداری را رعایت کرده‌اند. یافته‌ها: بررسی‌ها نشان می‌دهد که هر ژن به‌تنهایی مسئول انجام یک عمل نیست و ژن‌ها تعاملات پیچیده‌ای با یکدیگر دارند. به همین دلیل، پزشک نمی‌تواند با اطمینان خاطر از نتیجه ویرایش ژنی، این فرایند را انجام دهد، زیرا ممکن است این عمل با موفقیت انجام شود، اما مخاطرات آن در نسل‌های آینده فرد ظاهر شوند. نتیجه‌گیری: بررسی مستندات و یافته‌های فقهی و اصولی نشان می‌دهد که در عصر کنونی، ویرایش ژنی هسته سلول زایشی با هدف ارتقای صفات ژنتیکی، به دلیل به خطرانداختن جان یا سلامتی فرد و نسل‌های آینده، جایز نیست.</div> <div style="text-align: justify;">Background and Aim: "Bodily integrity" refers to the right an individual has over their physical integrity. This right includes the prohibition of causing harm, assault and any physical violation to the person. One of the novel techniques in genetic science is "germline gene editing to enhance genetic traits and characteristics". Therefore, the question arises that what is the jurisprudential ruling on germline gene editing to enhance genetic traits? Method: The process used in this emerging technology to enhance genetic traits such as increased vision, height, intelligence, etc., is that a new, active gene with superior characteristics is injected into the egg cell through IVF and then the engineered embryo is transferred to the woman's uterus so that the changes created in the structure and function of the body are applied. In order to obtain the Sharia ruling on this new technology, a library and documentary information collection method and a descriptive-analytical method have been used. Ethical Considerations: The authors have adhered to the originality of texts, honesty and trustworthiness in all stages of writing the research. Results: Studies show that each gene is not solely responsible for performing an action and genes have complex interactions with each other. For this reason, the doctor cannot perform this process with certainty of the outcome of gene editing; Because this operation may be successful, but its risks may appear in future generations of the individual. Conclusion: Review of jurisprudential and principled documents and findings shows that in the present era, germline gene editing to enhance genetic traits is not permissible due to endangering the life or health of the individual and future generations.
