fa تعهدات دولت‌ها به حفظ حق سلامت کودک در ازدواج‌های مخاطره‌آمیز از دیدگاه اسناد بین‌المللی و اتحادیه اروپا پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">زمینه و هدف:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">از یکسو حق بر سلامتی کودکان موضوع مهمی در اسناد بین‌المللی و منطقه‌ای است و از سوی دیگر حق بر ازدواج و تشکیل خانواده در ازدواج‌های مخاطره‌آمیز تهدیدی بالقوه برای نقض حق بر سلامت کودکان در آینده می‌باشد. تعارض این دو حق بشری که هر دو در اسناد بین‌المللی مورد توجه قرار گرفته شده‌اند، موجب عملکرد متفوت دولت‌ها به ویژه دولت‌های اروپایی و صدور آرای متفاوتی در سازوکارهای بین‌المللی و دیوان دادگستری اتحادیه اروپا شده است</span></span><span lang="AR-SA"><span style="line-height:115%">.<span style="font-family:&quot;B Nazanin&quot;"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">روش: </span></span></span></b><span lang="AR-SA"><span style="line-height:115%">این تحقیق از نوع نظری بوده و روش تحقیق به صورت توصیفی ـ تحلیلی است و روش جمع‌آوری اطلاعات به صورت کتابخانه‌ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است</span></span><span lang="AR-SA"><span style="line-height:115%">.</span></span><span lang="FA"><span style="line-height:115%"><span style="color:black"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">ملاحظات اخلاقی:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">در تحقیق حاضر، اصل امانتداری، صداقت، بی‌طرفی و اصالت اثر رعایت شده است</span></span><span lang="AR-SA"><span style="line-height:115%">.</span></span><span lang="FA"><span style="line-height:115%"><span style="color:black"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">یافته‌ها:</span></span></span></b><span lang="FA"><span style="line-height:115%"> به ‌طور کلی تعهدات دولت‌ها در برابر حق سلامت کودکان حاصل از ازدواج‌های مخاطره‌آمیز به دوران‌های پیش از ازدواج، پیش از بارداری، بارداری و پس از آن تقسیم می‌شود.</span></span> <span lang="AR-SA"><span style="line-height:115%">دولت‌های اروپایی نیز با اینکه برای جنین حقوقی را به رسمیت نشناخته‌اند، </span></span><span lang="FA"><span style="line-height:115%">اما </span></span><span lang="AR-SA"><span style="line-height:115%">نمی‌توانند حق سلامت کودک آینده را به خاطر عدم وجود بالفعل نادیده بگیرند و برای رعایت این حق موظف‌اند محدودیت‌هایی را به صورت ایجابی و یا سلبی بنا نهند.</span></span><b><span lang="FA"><span style="line-height:115%"><span style="font-family:&quot;B Nazanin&quot;"></span></span></span></b></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">نتیجه‌گیری:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">حق بر سلامت کودکان از سوی اتحادیه اروپا و اسناد بین‌المللی مورد توجه قرار گرفته است و زمانی که سلامت خانواده و به خصوص کودک آینده به خطر بیفتد و در نتیجه شاخص سلامت عمومی را به خطر بیندازد، در راستای تأمین شرایط و مقتضیات تحقق حق بر سلامت برای ایفای این تعهدات در نهاد خانواده مداخله می‌نماید. این دخالت می‌تواند همچون کشورهای جنوب اروپا، از جمله یونان و آلمان به صورت حداقلی انجام گیرد و یا مانند کشورهای سوئد و نروژ به صورت حداکثری باشد. </span></span><span lang="FA"><span style="line-height:115%">بنابراین میزان دخالت دولت‌ها در حق فرزندآوری زوجین در ازدواج‌های مخاطره‌آمیز، در رویکرد اتخاذی از سوی آن‌ها نهفته است.</span></span><span lang="AR-SA"><span style="line-height:115%"> همچنین میزان دخالت دولت در امور خصوصی افراد به صورت حداقلی است، اما اگر در ازدواج‌های مخاطره‌آمیز منافع والدین با منافع کودک در تعارض قرار گیرد، میزان مداخله دولت در این زمینه بر اساس مصالح عالیه کودک تعیین می‌گردد.</span></span></span></span></span></span></span></div> <div style="text-align: justify;"><span style="font-family:Tahoma;"><span style="font-size:12px;"><span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%"><span style="color:maroon">Background and Aim:</span></span></b><span style="line-height:115%"> On one hand, the right to children&#39;s health is an important subject in international and regional documents and on the other hand, the right to marriage and family formation in risky marriages poses a potential threat to the violation of children&#39;s health rights in the future. The conflict between these two human rights, both of which are emphasized in international documents, has led to different actions by governments, especially European governments and the issuance of different opinions in international mechanisms and the European Union Court of Justice.</span><b><span style="line-height:115%"><span style="font-family:&quot;Times New Roman&quot;,serif"></span></span></b></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%"><span style="color:maroon">Method:</span></span></b><span style="line-height:115%"> This research is theoretical in nature, using a descriptive-analytical research method. Data collection was library-based, involving the review of documents, books and articles.</span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span lang="EN"><span style="line-height:115%"><span style="color:maroon">Ethical Considerations:</span></span></span></b> <span style="line-height:115%">In this research, the principles of trustworthiness, honesty, impartiality and originality of work have been observed.</span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%"><span style="color:maroon">Results:</span></span></b><b> </b><span style="line-height:115%">In general, the commitments of governments towards the right to children&#39;s health resulting from risky marriages are divided into pre-marital, pre-pregnancy, pregnancy and post-pregnancy periods. European governments, while not recognizing legal rights for the fetus, cannot ignore the future health rights of children and are obligated to impose restrictions positively or negatively to uphold this right.</span></span></span><br> <span style="line-height:115%"><span style="color:black"><b><span style="line-height:115%"><span style="color:maroon">Conclusion:</span></span></b><b> </b><span style="line-height:115%">The right to children&#39;s health has been emphasized by the European Union and international documents. When the health of the family, especially the future child, is at risk and endangers public health indicators, intervention in the family institution is necessary to ensure the conditions for realizing the right to health. This intervention can be minimal as in Southern European countries like Greece and Germany or maximal as in countries like Sweden and Norway. Therefore, the level of government intervention in procreation rights of couples in risky marriages is embedded in their adopted approach.
