fa درآمدی بر پیش‌نویس عهدنامه حق بر توسعه با تأکید بر جایگاه حق بر سلامت An Introduction to the Draft Convention on the Right to Development with an Emphasis on the Position of the Right to Health پژوهشي Original Article زمینه و هدف: توسعه فرآیند جامع اقتصادی، اجتماعی، فرهنگی، مدنی و سیاسی است که با هدف بهبود مستمر رفاه کل جمعیت و همه افراد ایجاد می‌شود. از آنجا که حق بر توسعه در شمول حقوق بشر و از مصادیق حقوق نسل سوم (همبستگی) است، لذا در حقوق بین‌الملل معاصر، از قواعد غیر قابل سلب بشری در سراسر دنیا شناخته می‌شود. حق بر سلامت نیز بخشی اساسی از حقوق بشر است و برای نیل به زندگی شرافتمندانه و برخورداری از بالاترین استانداردهای قابل دستیابی سلامت جسمی و روانی ضروری تلقی می‌شود. نظر به اینکه تمامی حقوق بشر دارای وابستگی متقابل، تقسیم‌ناپذیر و مرتبط با یکدیگر هستند، ارتقای حق بر توسعه موجب می‌گردد که بهره‌مندی از سایر حقوق بشر، از جمله حق بر سلامت ارتقا یابد. روش: این تحقیق از نوع نظری بوده، و روش تحقیق به صورت توصیفی ـ تحلیلی است. روش گردآوری داده‌ها به صورت کتابخانه‌ای است و با مراجعه به اسناد، کتب و مقالات انجام شده است. ملاحظات اخلاقی: در تحقیق حاضر، اصل امانتداری، صداقت، بی‌طرفی و اصالت اثر رعایت شده است. یافته‌ها: عهدنامه حق بر توسعه به منزله برداشتن گامی مهم در تحقق حق مزبور شناخته می‌شود، نه‌تنها به این دلیل که الزام‌آور است، بلکه مشتمل بر هنجارهای عینی و دقیق‌تر در مقایسه با حقوق نرم قبل از خود است. نویسندگان در این مقاله به مطالعه و تدقیق پیش‌نویس معاهده حق بر توسعه پرداخته و زمینه ایجاد و ویژگی‌های آن از نظر محتوای هنجاری را با تأکید بر حق بر سلامت بررسی کرده‌اند. نتیجه‌گیری: گفتگو در خصوص «پیش‌نویس عهدنامه حق بر توسعه»، عملیاتی‌کردن این حق را در تمام جوامع مورد هدف قرار داده و روند ایجاد آن در نظام حقوق بین‌الملل دورنمای دیگری را در راستای محقق ساختن حق بر توسعه و فرا تر از آن، تحقق تمامی حقوق بشر از جمله حق بر سلامت نمایان کرده است.   Background and Aim: Development is a comprehensive economic, social, cultural, civil and political process aimed at the continuous improvement of the well-being of the entire population and all individuals. Since the right to development is encompassed within human rights and is an instance of third-generation rights (solidarity rights), it is recognized in contemporary international law as a non-derogable human right worldwide. The right to health is also a fundamental part of human rights and is considered essential for achieving a dignified life and enjoying the highest attainable standards of physical and mental health. Given that all human rights are interdependent, indivisible and interrelated, the promotion of the right to development leads to the enhancement of the enjoyment of other human rights, including the right to health. Method: This research is theoretical in nature and the research method is descriptive-analytical. The data collection method is library-based, conducted by referring to documents, books and articles. Ethical Considerations: In this research, the principles of honesty, integrity, impartiality and the originality of the work have been observed. Results: The Covenant on the Right to Development is recognized as a significant step towards the realization of this right, not only because it is binding but also because it contains more objective and precise norms compared to the soft law instruments that preceded it. In this article, the authors study and scrutinize the draft treaty on the right to development, examining its context of creation and its characteristics in terms of normative content, with an emphasis on the right to health. Conclusion: The dialogue concerning the "Draft Covenant on the Right to Development" targets the operationalization of this right in all societies. Its ongoing development within the international legal system has revealed new prospects for realizing the right to development and, beyond that, for achieving all human rights, including the right to health.
