fa حمایت‌های پزشکی و دارویی از اقشار آسیب‌پذیر در نظام حقوق بشر بین‌الملل با تأکید بر دیدگاه‌های علوی Medical and Pharmaceutical Support for Vulnerable Groups in the International Human Rights System with an Emphasis on Alavi's Views پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: حمایت‌های پزشکی و دارویی از اقشار آسیب‌پذیر در نظام حقوق بین‌الملل یکی از حقوق مرتبط با حق بر سلامت است، البته این حمایت‌ها هم برای سلامت جسمانی و هم برای سلامت روان اقشار آسیب‌پذیر را شامل می‌گردد. اقشار آسیب‌پذیر، البته از تعریف مشخصی در نظام حقوق بین‌الملل برخوردار نبوده و بر اساس عوامل اجتماعی، اقتصادی، فرهنگی و حتی فردی تقسیم‌بندی می‌شود. برای نمونه در یک تقسیم‌بندی، معتادین به مواد مخدر به عنوان اقشار آسیب‌پذیر تلقی می‌شوند که برخی از پزشکان، تمایل به درمان آن‌ها را ندارند، به ویژه زمانی که مبتلا به بیماری‌های عفونی هم چون ایذر شده باشند. اهدافی که در این تحقیق مد نظر می‌باشند، اولاً شناسایی حقوق پزشکی و دارویی اقشار آسیب‌پذیر از منظر نظام حقوق بین‌الملل؛ ثانیاً ترسیم دیدگاه‌های امام علی (ع) نسبت به حمایت‌های پزشکی و دارویی از اقشار آسیب‌پذیر و نهایتاً تطبیق میان رویکرد علوی و رویکرد موجود در نظام حقوق بین‌الملل نسبت به حمایت‌های پزشکی و دارویی از اقشار آسیب‌پذیر است. روش: این تحقیق از نوع نظری بوده و روش تحقیق به صورت توصیفی ـ تحلیلی است. روش جمع‌آوری اطلاعات در آن به صورت کتابخانه‌ای است و با مراجعه به اسناد، کتاب‌ها و مقالات صورت پذیرفته است. ملاحظات اخلاقی: در تحقیق حاضر، اصل امانتداری، صداقت، بی‌طرفی و اصالت اثر رعایت شده است. یافته‌ها: ریشه توجه به حمایت‌های پزشکی و دارویی از اقشار آسیب‌پذیر به ارتباط میان سلامت عمومی و حقوق بشری مربوط می‌شود، به نحوی که به واسطه غیر قابل جبران‌بودن نقض سلامت عمومی، هرگونه ارائه خدمات بهداشتی و درمانی به این اقشار در اولویت قرار بگیرد. از سوی دیگر، در نظام فکری علوی، علاوه بر سلامت جسمانی و روانی، دولت‌ها از تعهد به تأمین و تضمین حق بر سلامت معنوی برای اقشار آسیب‌پذیر برخوردارند، به ویژه آنکه این اقشار به دلایل فقر اقتصادی، اجتماعی و آموزشی، در معرض کیفیت پایین‌تری از این بعد سلامت هستند. نتیجه‌گیری: در ارتباط با اقشار آسیب‌پذیر، انواع مختلفی از حمایت‌های پزشکی و دارویی از اقشار آسیب‌پذیر در نظام حقوق بین‌الملل را می‌توان مورد اشاره قرار داد، از جمله در دسترس قراردادن مراکز پزشکی مخصوص بانوان یا کودکان، آموزش پزشکان متخصص کودکان و بانوان و رایگان‌نمودن خدمات پزشکی و دارویی برای اقشار آسیب‌پذیر. از منظر علوی نیز به موضوع حمایت‌های مختلف از اقشار آسیب‌پذیر خواه حمایت‌های مادی و خواه حمایت‌های معنوی تأکید شده است، به گونه‌ای که مهم‌ترین آن‌ها را می‌توان در توصیه‌های امام علی (ع) خطاب به مالک اشتر در نهج‌البلاغه ملاحظه نمود.  </div> <div style="text-align: justify;">Background and Aim: Medical and pharmaceutical support for vulnerable groups in the international legal system is one of the rights related to the right to health. Of course, this support includes both support for the physical health and mental health of vulnerable groups. Vulnerable groups, of course, do not have a specific definition in the international legal system and are divided based on social, economic, cultural and even individual factors. For example, in one division, drug addicts are considered vulnerable groups that some doctors do not want to treat, especially when they are infected with infectious diseases such as measles. The objectives of this research are, first, to identify the medical and pharmaceutical rights of vulnerable groups from the perspective of the international legal system, secondly, to outline the views of Imam Ali (AS) regarding medical and pharmaceutical support for vulnerable groups and finally, to reconcile the Alawi approach and the existing approach in the international legal system regarding medical and pharmaceutical support for vulnerable groups. Method: This research is theoretical and the research method is descriptive-analytical. The method of collecting information in it is library-based and is done by referring to documents, books and articles. Ethical Considerations: In the present research, the principles of trustworthiness, honesty, impartiality and originality of the work have been observed. Results: The root of attention to medical and pharmaceutical support for vulnerable groups is related to the relationship between public health and human rights, in such a way that due to the irreparable nature of violations of public health, any provision of health and treatment services to these groups is prioritized. On the other hand, in the Alawite intellectual system, in addition to physical and mental health, governments have the obligation to provide and guarantee the right to spiritual health for vulnerable groups, especially since these groups are exposed to a lower quality of this dimension of health due to economic, social and educational poverty. Conclusion: In relation to vulnerable groups, various types of medical and pharmaceutical support for vulnerable groups in the international legal system can be mentioned, including making medical centers available for women or children, training doctors specializing in children and women and making medical and pharmaceutical services free for vulnerable groups. From the Alawite perspective, the issue of various supports for vulnerable groups, whether material or spiritual support, has also been emphasized, so that the most important of them can be seen in the recommendations of Imam Ali (AS) addressed to Malik Ashtar in Nahjul-Balagha.
