fa بررسی تأثیر کاربست هوش مصنوعی در حیطه پزشکی بر مفهوم تقصیر Examining the Impact of Using Artificial Intelligence in Medicine on the Concept of Negligence پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: به دلیل پیچیدگی تصمیمات پزشکی، کاربرد سیستم‌های اینترنتی، از جمله هوش مصنوعی جهت پشتیبانی از این تصمیمات افزایش یافته است. ضرورت استفاده از نرم‌افزارهای جدید، واقعیاتی هستند که در علم پزشکی از لحاظ آثار حقوقی و از جمله مسئولیت مدنی حائز اهمیت هست. یکی از مهم‌ترین سؤالات حقوقی در این بخش این است که ورود هوش مصنوعی چه تأثیراتی بر روی مفاهیم و ارکان مربوط به مسئولیت مدنی، از جمله مفهوم تقصیر دارد. روش: این تحقیق از نوع نظری و به روش توصیفی ـ تحلیلی است و روش جمع‌آوری اطلاعات به روش کتابخانه‌ای و با مراجعه به اسناد، کتب و مقالات صورت گرفته است. ملاحظات اخلاقی: در پژوهش حاضر جنبه‌های اخلاقی مطالعات کتابخانه‌ای شامل اصالت متون، صداقت و امانتداری به طور کامل رعایت شده است. یافته‌ها: بحث اصلی بر سر مسأله تقصیر و معیارهای تشخیص آن در پزشکی هوشمند است. در این راستا با بررسی ماده 495 قانون مجازات اسلامی و مقررات خاص، تبیین هوش مصنوعی و کاربردهای آن در پزشکی، این یافته‌ها حاصل شد که جدای از اینکه نمی‌توان برای هوش مصنوعی قائل به مسئولیت جداگانه بود، باید مفهوم تقصیر را در این موارد به شیوه جدید و با در نظرگرفتن مقتضیات امر بررسی کرد. نتیجه‌گیری: تفاوت‌های هوش مصنوعی با سایر ابزار از جهت استقلال در تصمیم‌گیری، تحلیل تفاوت‌های این دو مبحث را ضروری می‌کند، ممکن است نظام حقوقی تمایل به مسئول‌دانستن ماشین مبتنی بر تکنولوژی هوش مصنوعی داشته باشد، به نظر نگارنده، دشوار است که بتوان برای آن قائل به شخصیت حقوقی و مسئولیت جداگانه بود. زمانی که یک پزشک در فرآیند درمان، جهت تشخیص بیماری و یا در مراحل دیگر مربوط به درمان از نرم‌افزارهای هوشمند بهره می‌گیرد و در نتیجه اعتماد پزشک به تشخیص هوش مصنوعی، به بیمار آسیب وارد می‌شود، بعد از اطمینان از به رسمیت شناخته‌شدن استفاده از هوش مصنوعی در امر درمان در نمونه مورد نظر، باید بررسی گردد که شیوه درمانی به کار گرفته‌شده، در علم پزشکی مطابق مقررات پزشکی است یا خیر و معیار در تشخیص تقصیر پزشک «رفتار پزشکی متعارف» است و این متعارف‌بودن باید در طرز استفاده از نرم‌افزار هوش مصنوعی نیز رعایت گردد.  </div> Background and Aim: Due to the complexity of medical decisions, the use of online systems such as artificial intelligence to support these decisions has increased. The necessity of using new software in the field of medicine in terms of legal effects, including civil liability, is important. One of the most important legal questions in this area is to see the impacts on concepts and elements related to civil liability, including the concept of malpractice. When we say that a physician has not acted in accordance with medical regulations and technical standards and his fault is presumed, how does this play out when artificial intelligence is involved? Method: This research is theoretical and uses a descriptive-analytical method. Information was collected through library research and by referring to documents, books and articles. Ethical Considerations: In this study, ethical aspects of library studies including the authenticity of texts, honesty and trustworthiness have been fully observed. Results: The main discussion revolves around the issue of malpractice and the criteria for diagnosing it in smart medicine. In this regard, there is a need to examine Article 495 of the Islamic Penal Code and specific regulations, explain artificial intelligence and its applications in medicine and then examine the differences between the current discussion and the discussion of civil liability arising from objects and finally, the legal implications of the use of artificial intelligence in medicine in the realm of physician malpractice in civil liability are addressed. Conclusion: The criterion for diagnosing physician malpractice is "standard medical practice"; the differences in artificial intelligence from other tools in decision-making; analyzing the differences between these two topics is necessary. The legal system may prefer to hold technology-based AI machines accountable, which needs to be examined. The use of artificial intelligence in treatment in the case under consideration is in accordance with medical regulations or not? However, the more important discussion here is whether the physician has acted in accordance with medical regulations and technical standards in using AI software for treatment.
