fa رویکرد دیوان بین‌المللی دادگستری در تفسیر قوانین و اصول حقوق بین‌الملل The Approach of the International Court of Justice in Interpreting the Rules and Principles of International Law پژوهشي Original Article زمینه و هدف: دیوان بین‌المللی دادگستری نقش مهمی در حل و فصل اختلافات بین‌المللی دارد که در این راستا از تفسیر قواعد حقوق بین‌الملل استفاده می‌کند. هدف مقاله حاضر بررسی رویکرد دیوان بین‌المللی دادگستری در تفسیر قوانین و اصول حقوق بین‌الملل است. روش: مقاله مورد اشاره توصیفی ـ تحلیلی بوده و از روش کتابخانه‌ای استفاده‌ شده است. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، اصالت متون، صداقت و امانتداری رعایت شده است. یافته‌ها: دیوان بین‌المللی دادگستری در برخی از آرای خود با استفاده از تفسیر پویا در مسیر تطابق قصد طرفین معاهده با مقتضیات زمان و نیازهای جامعه بین‌المللی و با کشف اراده واقعی طرفین، ابهامات موجود در حقوق بین‌الملل را رفع کرده است. تفسیر پویا ابزاری است که دیوان، گاه در تفسیر قواعد حقوقی به کار می‌گیرد و از طریق آن، قواعد را با توجه به وضعیت موجود جامعه بین‌المللی روزآمد می‌کند؛ تفسیری که مبتنی بر قصد طرفین است. رویه دیوان، متضمّن مصادیقی از توسل به این ابزار است و می‌توان در آینده کاربرد سودمند این نوع از تفسیر را در آینده، بیش از پیش کرد. نتیجه‌گیری: قواعد و مقررات حاکم بر تفسیر معاهدات بین‌المللی، از جمله ابزارهایی می‌باشند که دیوان بین‌المللی دادگستری به هنگام رسیدگی به قضایای مطروحه آن‌ها را به کار می‌گیرد. همین امر در توسعه حوزه‌های مختلف حقوق بین‌الملل تأثیرگذار بوده است.   Background and Aim: The International Court of Justice plays an important role in settling international disputes, but is settling disputes the only function of the court? The purpose of this article is to examine the approach of the International Court of Justice in interpreting the rules and principles of international law. Method: The mentioned article is descriptive and analytical and the library method was used. Ethical Considerations: In all stages of writing the present research, the originality of the texts, honesty and trustworthiness have been observed. Results: In some of its opinions, the International Court of Justice has resolved the ambiguities in international law by using dynamic interpretation in the way of matching the intention of the treaty parties with the requirements of the time and the needs of the international community and by discovering the real will of the parties. Dynamic interpretation is a tool that the court sometimes uses in the interpretation of legal rules and through it, it updates the rules according to the current situation of the international community; An interpretation that is based on the intention of the parties. Conclusion: The rules and regulations governing the interpretation of international treaties are among the tools that the International Court of Justice frequently uses when dealing with cases.
