fa حمایت از حق بر سلامت در اسناد غیر الزام‌آور حقوق بین‌الملل محیط زیست Protection of the Right to Health in Non-Binding Documents of International Environmental پژوهشي Original Article زمینه و هدف: حق بر سلامت یک حق بنیادین بوده و مطابق این حق انسان باید بیشترین معیار سلامت فیزیکی و روانی را داشته و از کلیه خدمات پزشکی، بهداشت عمومی، محیط کار و محیط زیست سالم که تجلی جایگاه بالایی همانند حق بر زندگی، حق بر سلامت طبق معیارهای جهانی دارا باشد. بنابراین دولت‌ها و اشخاص، بنا بر متون حقوق بشری نسل سوم دارای تکالیفی هستند. حق بر سلامت در اسناد غیر الزام‌آور مورد بررسی قرار گرفته که هدف مقاله بیان مفاهیم اساسی، تحلیل حق بر سلامت و رابطه آن با حق بر محیط زیست سالم در اسناد غیر الزام‌آور و تعهد دولت‌ها می‌باشد. روش: در این تحقیق روش توصیفی ـ تحلیلی نگارش و از منابع کتابخانه‌ای و فیش‌برداری استفاده ‌شده است. ملاحظات اخلاقی: در مقاله اصالت متن، صداقت و امانتداری رعایت شده است. یافته‌ها: مهم‌ترین یافته پژوهش این است که حق بر سلامتی ارتباط وثیقی با حق بر محیط زیست دارد و این امر در اسناد بین‌المللی غیر الزام‌آور محیط زیست منعکس که این انعکاس زمینه تحول تدریجی مناسبات میان حق بر سلامتی و حق بر محیط زیست را فراهم خواهد نمود. نتیجه‌گیری: برخورداری از حق بر سلامتی لازمه حق بر حیات و محیط زیست بوده، به طوری که کیفیت محیط ‌زیست و تضمین حق بهره‌مندی از محیط ‌زیست سالم را می‌توان پیش‌زمینه میزان بهره‌مندی بشر از حق بر سلامتی و کیفیت حیات عنوان نمود. ضرورت این امر در اسناد بین‌المللی غیر الزام‌آور حقوق محیط زیست مورد اشاره قرار گرفته و می‌تواند زمینه‌ساز تحول قواعد باشد. <div style="text-align: justify;">Background and Aim: From the basic human rights, the right to health is an inherent right, to have the highest standard of physical and mental health and from all medical services, public health, work environment and healthy living environment, which is a manifestation of a high position, such as the right to life, the right to health according to have global standards. Therefore, governments and individuals have duties according to the third generation human rights texts. The right to health has been examined in non-binding documents and the purpose of the article is to express the basic concepts, analyze the right to health and its relationship with the right to a healthy environment in non-binding documents and the commitment of governments. Method: In this research, the descriptive analytical writing method was used and library sources and data collection were used. Ethical Considerations: In the article, the originality of the text, honesty and trustworthiness have been observed. Results: The most important finding of the research is that the right to health is closely related to the right to the environment. And this is reflected in non-binding international environmental documents. This reflection will provide the basis for the gradual transformation of the relationship between the right to health and the right to the environment. Conclusion: Having the right to health is a requirement of the right to life and the environment. The quality of the environment and the guarantee of the right to benefit from a healthy environment can be called the background of the amount of human benefit from the right to health and quality of life. The necessity of this is mentioned in the non-binding international documents of environmental rights and can be the basis for the evolution of the rules.
