fa ارزیابی رویکرد فقهی ـ حقوقی نسبت به شرایط پیوند عضو از حیوان به انسان با تأکید بر ضرورت‌های پزشکی Evaluation of the Jurisprudential-Legal Approach to the Conditions of Organ Transplantation from Animals to Humans with an Emphasis on Medical Necessity پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: پیوند عضو از حیوان به انسان، آینده علوم پیوندی را دچار چالش‌های عمده فقهی ـ حقوقی نموده است، اگرچه با توجه به مزایایی همچون متناسب‌نمودن عرضه و تقاضا در زمینه پیوند عضو، طولانی‌بودن مدت انتظار برای دریافت عضو پیوندی و...، ضرورت‌های پزشکی ایجاب می‌نماید که پیوند عضو از حیوان به انسان صورت بگیرد، اما در مقابل، خطر انتقال بیماری‌های عفونی و ویروسی از حیوان به انسان و عدم پذیرش عضو پیوندی از حیوان به انسان از معایب این نوع پیوند برشمرده است. روش: در این پژوهش از روش توصیفی ـ تحلیلی استفاده شده است. ملاحظات اخلاقی: در تمامی مراحل نگارش صداقت و امانتداری رعایت شده است. یافته‌ها: یافته‌های پژوهش نشان می‌دهد، با توجه به اینکه همچنان در سطح قوانین داخلی جمهوری اسلامی ایران، قوانینی به صورت خاص در این حوزه به تصویب نرسیده است و حتی وزارت بهداشت، درمان و آموزش پزشکی نیز فاقد دستورالعمل‌ها و آیین‌نامه‌های خاص است، لذا بر اساس اصول قانون اساسی باید به موازین عام فقهی در این خصوص مراجعه نمود. در این خصوص، سؤال اصلی آن است که رویکرد فقهی ـ حقوقی نسبت به شرایط پیوند عضو از حیوان به انسان با توجه به ضرورت‌های پزشکی چیست؟ نتیجه‌گیری: نتیجه تحقیق به این صورت است که در فقدان قواعد موضوعه، باید گفت که از نظر فقه امامیه، پیوند عضو از حیوان به انسان در شرایط اضطرار منعی ندارد، مگر در مواردی که مفسده‌ای با خود داشته باشد.</div> <div style="text-align: justify;">Background and Aim: Organ transplantation from animals to humans has posed major jurisprudential and legal challenges for the future of transplantation sciences. Although, considering the advantages such as matching supply and demand in the field of organ transplantation, the long waiting period for receiving a transplanted organ, etc., medical necessities require that organ transplantation from animals to humans be performed, on the other hand, the risk of transmitting infectious and viral diseases from animals to humans and the refusal to accept an organ transplant from animals to humans are among the disadvantages of this type of transplantation. Method: This study used a descriptive-analytical method. Ethical Considerations: Honesty and trustworthiness have been observed in all stages of writing. Results: The findings of the study show that, given that no specific laws have been passed in this area at the level of the domestic laws of the Islamic Republic of Iran and even the Ministry of Health, Treatment and Medical Education lacks specific guidelines and regulations, therefore, based on the principles of the Constitution, general jurisprudential standards should be referred to in this regard. In this regard, the main question is what is the jurisprudential and legal approach to the conditions of organ transplantation from animals to humans with regard to medical necessities? Conclusion: The result of the research is that in the absence of established rules, it must be said that according to Imami jurisprudence, organ transplantation from animals to humans is not prohibited in emergency situations, except in cases where it involves corruption.
