fa پیوند اعضا و چالش‌های حقوقی و اخلاقی: نگاهی تطبیقی به قوانین سوییس، فرانسه و آلمان پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">زمینه و هدف:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%"><span style="color:black">امروزه بیشتر کشورهای غربی، به دلیل روندِ نزولیِ تصادفات رانندگی منتهی به فوت، با کاهش قابل‌ توجه اهدای عضوِ افراد دچار مرگ مغزی مواجه می‌باشند. این مسأله تا حدود زیادی، زمینه را برای قاچاق عضو در پوشش توریسم پیوند اعضا فراهم کرده است. گفتنی است پدیده قاچاق عضو، به ویژه از اواسط دهه 1990 میلادی، به دلیل کمبود عضو قابل اهدا رشد فناوری‌های پیوند، سهولت ارتباطات و جا به جایی افراد، افزایش فقر و آسیب‌پذیری اعطاکنندگان عضو از یکسو و نبود یا ناکافی‌بودن مقررات ناظر به اعطای عضو شدت گرفت.</span></span></span><b><span lang="FA"><span style="line-height:115%"><span style="font-family:&quot;B Nazanin&quot;"></span></span></span></b></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">روش:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%"><span style="color:black">روش به کار گرفته‌شده در این تحقیق، توصیفی ـ تحلیلی است. در این راستا، از منابع معتبر کتابخانه‌ای برای گردآوری مطالب استفاده شده است.</span></span></span><span lang="FA"><span style="line-height:115%"><span style="color:black"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">ملاحظات اخلاقی:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">در این روش، اصول اخلاقی و امانتداری علمی رعایت شده است.</span></span><b><span lang="FA"><span style="line-height:115%"><span style="color:black"></span></span></span></b></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">یافته‌ها:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">در پاسخ به وضعیت، کشورهای مختلف به منظور پیشگیری از قاچاق عضو و مقابله با سوءاستفاده از موقعیت آسیب‌پذیر داوطلبان اهدای عضو، مداخله در دو حوزه اهدای عضو از شخص زنده و نیز دریافت عضو از متوفی، قانونگذاری و شرایط هر کدام در پرتو اسناد اروپایی تعیین نمودند.</span></span><span lang="FA"><span style="line-height:115%"><span style="color:black"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">نتیجه‌گیری:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">اساسی‌سازی اصول اخلاقی در این حوزه مانند اساسی‌سازی توزیع عادلانه و ممنوعیت تجارت اعضای بدن و الزام قانون عادی به قانونگذاری در پرتو کرامت انسانی اولویت امری اجتناب‌ناپذیر است.</span></span><span dir="LTR"><span style="line-height:115%"><span style="font-family:&quot;Times New Roman&quot;,&quot;serif&quot;"></span></span></span></span></span></span></span></span><br> &nbsp;</div> <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="color:maroon">Background and Aim:</span></b> Nowadays, most Western countries are facing a significant decline in organ donation from brain-dead individuals due to the decreasing trend of fatal traffic accidents. This issue has largely created an environment conducive to organ trafficking under the guise of transplant tourism. Notably, the phenomenon of organ trafficking, especially since the mid-1990s, has intensified due to the shortage of transplantable organs, advancements in transplantation technology, ease of communication and transportation, increasing poverty and the vulnerability of organ donors on the one hand and the absence or insufficiency of regulations governing organ donation on the other.<span style="font-family:&quot;Times New Roman&quot;,&quot;serif&quot;"></span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="color:maroon">Method:</span></b> The research method employed in this study is descriptive-analytical.
