fa مقابله با برنامه‌های ماهواره‌ای از طریق پخش پارازیت از منظر حقوق بین‌الملل و مسئولیت دولت‌ها در برابر سلامت شهروندان با تأکید بر مؤلفه‌های حاکمیتی Countering Satellite Programs through Jamming from the Perspective of International Law and the Responsibility of Governments Towards the Health of Citizens, with an Emphasis on Governance Components پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: اعمال پارازیت بر روی برنامه‌های ماهواره‌ای از سابقه‌ای چندین دهه برخوردار است. دولت‌ها به دلیل اعمال حاکمیت، بر روی برنامه‌های ماهواره‌ای اقدام به اعمال پارازیت می‌نمایند، اما این پارازیت‌ها بر روی سلامت شهروندان تأثیرات سوئی بر جای می‌گذارد که در این مقاله مورد توجه قرار می‌گیرد. اهدافی که از این پژوهش مورد نظر است: اولاً بررسی رویکرد موجود در نظام‌های حقوقی داخلی و نظام حقوق بین‌الملل ناظر بر تأثیرات پخش پارازیت بر سلامت شهروندان؛ ثانیاً ارزیابی مسئولیت دولت‌ها و ترسیم محدوده‌های حاکمیتی دولت‌ها در این زمینه است. روش: مقاله حاضر با روش توصیفی ـ تحلیلی و با مراجعه به منابع کتابخانه‌ای گردآوری شده است. ملاحظات اخلاقی: در روند تألیف این پژوهش، بر ملاحظات اخلاقی پژوهش کتابخانه‌ای از جمله اصالت متون، صداقت و امانتداری اهتمام ورزیده شده است. یافته‌ها: تقابل میان پارازیت‌های ماهواره‌ای، تأثیرگذاری بر حق بر سلامت شهروندان و لزوم احترام به حاکمیت ملی کشورها، از چند جهت عمده می‌تواند مطرح شود: اولاً اینکه آیا حق بر سلامت شهروندان از اهمیت بیشتر یا کمتر نسبت به احترام به حاکمیت ملی کشورها در زمینه پارازیت‌های ماهواره‌ای برخوردار است؟؛ ثانیا آیا داده‌های متقن علمی در ارتباط با تأثیرگذاری پارازیت‌های ماهواره‌ای بر حق بر سلامت شهروندان وجود دارد؟؛ ثالثاً آیا انحراف از حق بر سلامت شهروندان در پارازیت‌های ماهواره‌ای به دلیل ملاحظات حاکمیتی وجود دارد؟ نتیجه‌گیری: با توجه به مطلق‌نبودن حق بر سلامت در اسناد حقوق بین‌الملل بشر، از جمله بند 1 ماده 4 میثاق بین‌المللی حقوق مدنی و سیاسی، ماده 15 کنوانسیون اروپایی حقوق بشر، بند 1 ماده 27 کنوانسیون آمریکایی حقوق بشر و ماده 4 منشور حقوق بشر عرب، بایستی گفت که یک دولت می‌تواند صرفاً در «وضعیت اضطراری» برای نمونه نارامی‌های شدید سیاسی، آشوب‌ها و...، به اعمال پارازیت‌های ماهواره‌ای به دلیل ملاحظات حاکمیتی بپردازد، اما در صورتی که این امر استمرار یابد خود نقض تعهدات حقوق بشری دولت مزبور است، چراکه حق بر سلامت شهروندان نمی‌تواند به دلیل ملاحظات حاکمیتی در معرض انواع پارازیت‌های ماهواره‌ای نقض گردد.</div> <div style="text-align: justify;">Background and Aim: The use of jamming on satellite programs has a history of several decades. Governments, in order to exercise their sovereignty, jam satellite programs, but this jamming has adverse effects on the health of citizens, which is considered in this article. The objectives of this research are: First, to examine the existing approach in domestic legal systems and the international legal system regarding the effects of jamming on the health of citizens; Second, to assess the responsibility of governments and to outline the boundaries of government sovereignty in this field Method: The present article was compiled using a descriptive-analytical method and by referring to library sources Ethical Considerations: In the process of writing this research, attention was paid to the ethical considerations of library research, including the originality of texts, honesty, and trustworthiness. Results: The conflict between satellite jamming, the impact on the right to health of citizens, and the need to respect the national sovereignty of countries can be raised from several major aspects: First, is the right to health of citizens more or less important than respect for the national sovereignty of countries in the context of satellite jamming? Second, is there solid scientific data regarding the impact of satellite jamming on the right to health of citizens? Third, is there a deviation from the right to health of citizens in satellite jamming due to sovereign considerations? Conclusion: Given the non-absolute nature of the right to health in international human rights documents, including Article 4, Paragraph 1 of the International Covenant on Civil and Political Rights, Article 15 of the European Convention on Human Rights, Article 27, Paragraph 1 of the American Convention on Human Rights, and Article 4 of the Arab Charter on Human Rights, it should be said that a state can only engage in satellite jamming due to sovereign considerations in a "state of emergency" such as severe political unrest, riots, etc., but if this continues, it is a violation of the state's human rights obligations, because the right to health of citizens cannot be violated due to sovereign considerations.
