fa مبانی متکثّر مسئولیت بین‌المللی ناشی از شیوع پاندمی‌های کشنده Multiple Foundations of International Responsibility Raised of Outbreak of Deadly Pandemics پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: با گسترش ویروس کرونا در اواخر سال 2019، شیوع پاندمی‌های کشنده، بار دیگر به عنوان تهدیدی برای حیات انسانی مورد توجه قرار گرفتند و سازمان جهانی بهداشت نیز با اعلام وضعیت اضطراری بهداشتی جهانی، دولت‌ها را به رعایت مقررات بین‌المللی و اقدامات احتیاطی فراخواند. از آنجا که شیوع ویروس منشأ پاندمی کشنده ممکن است ناشی از اقدامات یک یا چند دولت باشد، هدف پژوهش حاضر این است که از منظر حقوق بین‌الملل، مبانی ممکن برای ارزیابی مسئولیت بین‌المللی دولت‌ها را ارزیابی نماید. روش: در این پژوهش، گردآوری اطلاعات با روش کتابخانه‌ای و پردازش آن‌ها با روش توصیفی ـ تحلیلی انجام شده است و روش استنتاج نیز استنتاج منطقی حقوقی با تکیه به منابع حقوق بین‌الملل است. ملاحظات اخلاقی: نویسندگان این مقاله کاملاً به اصول اخلاقی، صداقت، بی‌طرفی و حقوق مالکیت مادی ـ معنوی پایبند بوده‌اند. یافته‌ها: پژوهش حاضر نشان می‌دهد که علاوه بر منابع تعهد در حقوق بین‌الملل که نقض آن‌ها موجب مسئولیت بین‌المللی است، ارتکاب اعمالی که در حقوق بین‌الملل منع‌ نشده، ولی منجر به خسارت به سایر دولت‌ها می‌شود نیز می‌تواند در صورت بروز یک پاندمی مهلک مبنای مسئولیت بین‌المللی دولت باشد. نتیجه‌گیری: عدم ایفای تعهدات ناشی از مقررات بهداشتی بین‌المللی مصوب سازمان جهانی بهداشت، از جمله تعهد به همکاری بین‌المللی و تعهد به پیشگیری در کنار نقض تعهدات بین‌المللی حقوق بشر مبانی عمده مسئولیت بین‌المللی ناشی از شیوع پاندمی کشنده هستند. همچنین اقداماتی که در حقوق بین‌الملل منع نشده‌اند، از جمله در حوزه حقوق غذا یا حقوق حیوانات، در صورت بروز خسارت فراسرزمینی می‌تواند منجر به مسئولیت دولت ذی‌ربط شود.  </div> <div style="text-align: justify;">Background and Aim: With the outbreak of the corona virus at the end of 2019, the outbreak of deadly pandemics was once again considered as a threat to human life, and the World Health Organization, by declaring a global health emergency, called states to comply with international regulations and called for precautionary measures. Since the outbreak of a deadly pandemic virus may be caused by the actions of one or more states, the purpose of this study is to evaluate the possible bases for evaluating the international responsibility of states from the point of view of international law. Method: In this research, information has been collected by library method and processed by descriptive-analytical method, and the inference method is logical legal inference based on international law sources. Ethical Considerations: The authors of this article have fully adhered to the principles of ethics, honesty, neutrality, and material-spiritual property rights. Results: The present research shows that in addition to the sources of obligations in international law, the violation of which causes international responsibility, the commission of acts that are not prohibited in international law but lead to damage to other states. It can be the basis of the states international responsibility in the event of a deadly pandemic. Conclusion: Non-fulfillment of obligations arising from international health regulations approved by the World Health Organization, including the obligation to international cooperation and the commitment to prevent, in addition to the violation of international human rights obligations, the main principles of international responsibility due to the outbreak of a deadly pandemic. are Also, actions that are not prohibited in international law, such as in the field of food rights or animal rights, can lead to the responsibility of the relevant state in case of extraterritorial damage.
