fa امکان‌سنجی کاربرد هوش مصنوعی در دادرسی‌های امور پزشکی و درمانی با تأکید بر الزامات حاکمیتی در رعایت حریم خصوصی اشخاص پژوهشي Original Article <span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">زمینه و هدف:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%"><span style="color:black">دادرسی‌های پزشکی، سهم بزرگی از رسیدگی‌های قضایی را تشکیل می‌دهند. موضوع دعاوی پزشکی و درمانی از منظر حفاظت از حریم خصوصی اشخاص از سایر دعاوی اهمیت بیشتری دارد، چراکه هرگونه افشای اطلاعات مربوط به پرونده‌های پزشکی، می‌تواند اعتبار هر یک از طرفین دعوی (پزشکان، بیمارستان‌ها، بیمار) را تحت‌الشعاع قرار دهد. سؤالی که در این مقاله که به روش توصیفی ـ تحلیلی صورت گرفته، این است که با توجه به الزامات حاکمیتی در رعایت حریم خصوصی اشخاص، کاربرد هوش مصنوعی در دادرسی‌های امور پزشکی و درمانی، چه نکات ایجابی و سلبی دارد؟</span></span></span><b><span lang="FA"><span style="line-height:115%"><span style="font-family:"B Nazanin""></span></span></span></b></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">روش:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">روش تحقیق در این مقاله، توصیفی ـ تحلیلی است و در این راستا، از منابع معتبر کتابخانه‌ای استفاده شده ‌است.</span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">ملاحظات اخلاقی:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">در تمامی مراحل این تحقیق، اصول اخلاق پژوهش رعایت شده است، از جمله رعایت صداقت و امانتداری در گردآوری و تحلیل اطلاعات، استفاده از منابع معتبر و استناد دقیق به آن‌ها و حفظ حریم خصوصی و محرمانگی اطلاعات در صورت استفاده از داده‌های حساس.</span></span><b><span lang="FA"><span style="line-height:115%"><span style="color:black"></span></span></span></b></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">یافته‌ها:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">بررسی‌های انجام‌شده نشان می‌دهد که هوش مصنوعی در حوزه دادرسی‌های پزشکی و درمانی می‌تواند نقش مؤثری در بهبود کارایی، دقت و سرعت فرآیندهای قضایی ایفا کند. مطالعات مختلف به کارگیری هوش مصنوعی در تحلیل داده‌های پزشکی، تشخیص خطاهای درمانی و پیش‌بینی نتایج درمانی اشاره دارند، با این حال، چالش‌های حقوقی و اخلاقی متعددی نیز مطرح است، از جمله این چالش‌ها می‌توان به نگرانی‌های مربوط به حفظ حریم خصوصی بیماران، امنیت داده‌های پزشکی، مسئولیت‌پذیری در صورت بروز خطاهای هوش مصنوعی و تبعیض‌های الگوریتمی اشاره کرد.</span></span><span lang="FA"><span style="line-height:115%"><span style="color:black"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">نتیجه‌گیری:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">استفاده از هوش مصنوعی در دادرسی‌های امور پزشکی و درمانی، پتانسیل بالایی برای بهبود فرآیندهای قضایی دارد. با این حال، برای بهره‌برداری مؤثر و اخلاقی از این فناوری، توجه به الزامات حاکمیتی در حفظ حریم خصوصی اشخاص و تدوین چهارچوب‌های قانونی مناسب ضروری است.</span></span><span dir="LTR"><span style="line-height:115%"><span style="font-family:"Times New Roman",serif"></span></span></span></span></span></span></span></span><br> &nbsp; <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%"><span style="color:maroon">Background and Aim: </span></span></b><span style="line-height:115%">Medical trials constitute a large proportion of judicial proceedings. The subject of medical and medical litigation is more important than other litigation from the perspective of protecting the privacy of individuals, because any disclosure of information related to medical records can overshadow the credibility of any party to the lawsuit (doctors, hospitals, patients). The question in this article, which is conducted in a descriptive-analytical manner, is: What are the positive and negative points of the use of artificial intelligence in medical and medical proceedings, considering the governmental requirements for respecting the privacy of individuals?<span style="color:maroon"></span></span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%"><span style="color:maroon">Method: </span></span></b><span style="line-height:115%">The research method in this article is descriptive-analytical and in this regard, reliable library sources have been used.<span style="color:maroon"></span></span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%"><span style="color:maroon">Ethical considerations: </span></span></b><span style="line-height:115%">In all stages of this research, the principles of research ethics have been observed. Including: respecting honesty and trustworthiness in collecting and analyzing information, using reliable sources and citing them accurately and maintaining privacy and confidentiality of information in the case of using sensitive data.<span style="color:maroon"></span></span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%"><span style="color:maroon">Findings: </span></span></b><span style="line-height:115%">The conducted studies show that artificial intelligence in the field of medical and therapeutic proceedings can play an effective role in improving the efficiency, accuracy and speed of judicial processes. Various studies refer to the use of artificial intelligence in analyzing medical data, detecting medical errors and predicting treatment outcomes. However, there are also numerous legal and ethical challenges. Among these challenges, we can mention concerns related to protecting patient privacy, medical data security, liability in the event of AI errors and algorithmic discrimination<span style="color:maroon">.</span></span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%"><span style="color:maroon">Conclusion: </span></span></b><span style="line-height:115%">The use of artificial intelligence in medical and therapeutic proceedings has great potential to improve judicial processes.
