fa بررسی رویه سازمان نظام پزشکی استان یزد در احراز خطاهای دندان‌پزشکان طی سال‌های 1402-1400 Study on the Procedure of the Yazd Province Medical System Organization, Regarding Proving the Errors of Dentists During the Years 1400-1402 پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: امروزه، دندان‌پزشکان و کادر همراه آنان، همانند سایر پزشکان در معرض شکایت بیماران قرار دارند. گاهی اوقات، خطا در اعمال دندان‌پزشکی، موجب بروز ضایعات دندانی شده و بیمار که با صرف هزینه گزاف، نتیجه درمانی مطلوب را به دست نیاورده است، اقدام به طرح شکایت علیه دندان‌پزشک می‌کند. ازآنجاکه درباره مسئولیت کیفری دندان‌پزشکان، مطالب زیادی وجود ندارد، این تحقیق ضمن بررسی اظهارنظرات کارشناسان کمیسیون‌های نظام پزشکی استان یزد، به بررسی عواملی که در احراز یا عدم احراز خطای دندان‌پزشکان نقش دارد، می‌پردازد. روش: این تحقیق از نوع نظری بوده، روش تحقیق به صورت توصیفی ـ تحلیلی می‌باشد؛ روش جمع‌آوری اطلاعات به صورت کتابخانه‌ای و با مراجعه به اسناد، کتب، مقالات و آرای کمیسیون نظام پزشکی استان یزد صورت گرفته است. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. یافته‌ها: در هر پرونده، عوامل متعددی ممکن است موجب انتساب یا عدم انتساب خطا به دندان‌پزشک شود. یافته‌ها نشان می‌دهد ازمنظر پزشکی، عواملی وجود دارد که در عدم احراز خطای دندان‌پزشکی مؤثر است. نتیجه‌گیری: بررسی‌ها حاکی‌از آن است که اشتباه دندان‌پزشک در تشخیص، نظیر عدم ارزیابی مناسب دندان و خطای مربوط به نحوه درمان نظیر کشیدن دندان‌ها در شرایطی که قابلیت نگهداری دارد، تراش بیشازحد دندان‌ها و دستکاری بیش از حد موضع عمل جراحی از مصادیق خطا در حوزه دندان‌پزشکی محسوب می&lrm;شود، اما اگر اقدامات دندان‌پزشک با رعایت موازین علمی صورت بگیرد و عارضه رخ‌داده، جزء عوارض شناخته‌شده جراحی دندان باشد، خطایی متوجه دندان‌پزشک نیست. به طور مثال ازمنظر کارشناسان نظام پزشکی، شکستن فایل در داخل کانال ریشه، کبودی در فک و سوختگی لب به دلیل کشیدن دندان از عوارض محتمل و شایع درمان محسوب می‌گردد؛ اگر دندان‌پزشک عمومی، با تشخیص صحیح، بیمار را جهت ادامه درمان تخصصی‌تر به دندان‌پزشک متخصص نظیر اندودنتیست‌ها ارجاع دهد، این امر موجب قطع قابلیت انتساب آسیب به دندان‌پزشک می‌گردد. همچنین اگر با وجود خطای دندان‌پزشک، هیچ‌گونه عارضه‌ای برای بیمار به وجود نیامده باشد؛ این امر مانع احراز مسئولیت کیفری دندان‌پزشک می‌گردد.  </div> <div style="text-align: justify;">Background and Aim: Today, dentists and their accompanying staff, like other doctors, are subject to patient complaints. sometimes, mistakes in dental practices cause dental lesions and the patient who did not get the desired treatment result by spending exorbitant costs, files a complaint against the dentist. Since there is not much information about the criminal liability of dentists, this research, while examining the opinions of experts of the Medical System Commissions of Yazd province, investigates the factors that play a role in the verification or non-verification of dentists' mistakes. Method: This research is of a the oretical type, the research method is descriptive and analytical and the method of collecting information is library-based, referring to documents, books and articles and opinions of the Medical System Commission of Yazd Province. Ethical Considerations: In all stages of writing the present research, while respecting the originality of the texts, honesty and trustworthiness have been observed. Results: In each case, several factors may cause attribution or non-attribution of fault to the dentist. the results show that, from a medical point of view, there are factors that are effective in preventing dental errors. Conclusion: The research indicates that the dentist's mistake in diagnosis, such as not properly evaluating the tooth and the error related to the method of treatment, such as extracting teeth in conditions that can be maintained, excessive grinding of teeth and excessive manipulation of the surgical site, are examples of errors in the field of dentistry.but if the dentist's actions are carried out in accordance with scientific standards and the complication is one of the known complications of dental surgery, then the dentist is not at fault. for example, from the point of view of the experts of the Medical System, breaking of the file inside the root canal, bruising in the jaw and burning of the lip due to tooth extraction are possible and common side effects of the treatment; If the general dentist, with a correct diagnosis, refers the patient to a specialist dentist such as an endodontist to continue more specialized treatment, this will stop the possibility of attributing damage to the dentist. Also, if despite the dentist's mistake, no complications have occurred for the patient; This prevents the criminal liability of the dentist.
