fa انگاره عدم سلامت جنسی زوج در عرف پزشکی و تأثیر آن در تحقق عسر و حرج زوجه The Concept of the Couple's Sexual Health in Medical Practice and Its Effect on the Wife's Distress and Embarrassment پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: مباحث مربوط به سلامت زوج نقش مهمی در محقق‌شدن حق زوجه در بهره‌مندی از حق نیاز داشتن به تأمین نیازهای جنسی ایفا می‌کنند. با توجه به ملاحظات پزشکی، فقهی و حقوقی در بیان مصادیق سلامت جنسی، پژوهش حاضر درصدد است تا سلامت جنسی زوج را بر تحقق عسر و حرج زوجه بررسی نماید. روش: مقاله حاضر به شیوه توصیفی ـ تحلیلی بوده و ابزار مورد استفاده نیز کتابخانه‌ای و اسنادی است. ملاحظات اخلاقی: در تدوین و نگارش مقاله حاضر اصول و معیارهای اخلاقی، از جمله استناددهی و امانتداری رعایت شده است. یافته‌ها: بر مبنای قاعده عسر و حرج و همسو با عرف پزشکی، عدم سلامت جنسی زوج در صورتی که مبتلا به بیماری صعب‌العلاج، مسری و ایجاد مانع برای برآورده‌شدن نیازهای جنسی زوجه باشد، این حق را برای وی محفوظ می‌دارد که از زوج دوری نماید، زیرا موارد عدم سلامت زوج مصداق عسر و حرج برای زوجه محسوب می‌شود، ضمن اینکه ضعف و ناتوانی جنسی زوج به هر دلیلی که حادث شود، نباید از حق زن برای محقق‌کردن نیاز خود بیش از چهار ماه عبور نماید. نتیجه‌گیری: بیماری زوج و عدم تحقق نیازهای جنسی زوجه، هرچند باعث تضییع حق زن در زمینه تأمین نیازهای جنسی وی تلقی می‌شود، اما موجب جواز عدم تمکین وی در سایر موارد نیست، بلکه زوجه می‌تواند با در نظرگرفتن ملاحظات و نوع بیماری زوج از مقاربت با وی خودداری نماید. این توصیه هم در فقه و منابع پزشکی و هم در ماده 1127 قانون مدنی مورد اشاره واقع شده است.  </div> <div> <table align="left" hspace="0" vspace="0"> <tbody> <tr> <td align="left" style="padding-top:0cm; padding-right:12px; padding-bottom:0cm; padding-left:12px" valign="top"> <div style="text-align: justify;">Background and Aim: Issues related to the health of the couple play an important role in realizing the wife's right to enjoy the right to meet sexual needs. According to the medical, jurisprudential and legal considerations in the expression of examples of sexual health, the present research is trying to investigate the issue of the sexual health of the couple, the realization of the difficulty and embarrassment of the wife. Method: This article is descriptive and analytical and the tools used are library and documents. Ethical Considerations: In compiling and writing this article, ethical principles and standards, including citation and trustworthiness, have been observed. Results: Based on the rule of difficulty and embarrassment and in line with medical custom, if the couple is suffering from an incurable, contagious disease and creates an obstacle for the fulfillment of the sexual needs of the wife, he reserves the right for him to have sexual health. Avoid the couple. Because cases of the husband's ill health are examples of hardship and embarrassment for the wife. In addition, the sexual weakness and impotence of the couple, for whatever reason, should not exceed the right of the woman to fulfill her needs for more than four months. Conclusion: Although husband's illness and wife's sexual needs are not fulfilled, it is considered as a violation of the woman's right to satisfy her sexual needs, but it does not justify her disobedience in other cases. Rather, the wife can refrain from intercourse with the husband, taking into account the considerations and the type of illness of the husband.
