fa تحلیل محتوای آرای قضایی صادره از محاکم در حوزه اختلالات روانی Content Analysis of Judicial Rulings Issued by Courts in the Field of Mental Disorders پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: ارائه تعاریف مختلف از اختلالات روانی و طبقه‌بندی‌های آن‌ها، از نظر علمی و عملی دارای آثار متعددی است. با درک اینکه وجود نگرش علمی نسبت به مفاهیم روان‌شناسی در حوزه حقوق، می‌تواند آثار و تبعات عملی بسیار مهمی را به همراه داشته باشد، نوشتار حاضر به دنبال بررسی نگرش مقامات قضایی نسبت به اختلالات روانی است. روش: نوشتار حاضر با استفاده از روش تحلیل محتوا و با بهره‌گیری توأمان از رویکردهای کمی و کیفی، آرای صادره از محاکم مختلف (اعم از بدوی و تجدید نظر) و دیوان ‌عالی کشور را مورد بررسی قرار داده است. جامعه آماری کلیه آرای صادره از محاکم و نمونه پژوهش حاضر، آرایی است که به صورت مستقیم در حوزه اختلالات روانی و مفاهیم روان‌شناختی صادر شده‌اند. ملاحظات اخلاقی: در مقاله حاضر، اصول اخلاقی، صداقت، رعایت حقوقی، رازداری و اصل مالکیت مادی ـ معنوی رعایت شده است. یافته‌ها: نتایج حاصل از پژوهش نشان‌دهنده عدم آشنایی کامل و دقیق مقامات قضایی با مفاهیم روان‌شناختی، وجود نگرش‌های افراطی و تفریطی نسبت به این اختلالات و نیز وجود دیدگاه‌های مختلف (و بعضاً غیر علمی) در خصوص حدود و ثغور این اختلالات است. نتیجه‌گیری: نتایج پژوهش حاضر نشان می‌دهد که نگرش مقامات قضایی نسبت به اختلالات روانی متنوع و غالباً غیر علمی است و در تفسیر مفاهیم روان‌شناختی اغلب افراط و تفریط مشاهده می‌شود. این نگرش‌ها می‌تواند هم موجب گسترش حمایت از حقوق افراد مبتلا و هم محدودشدن آن شود.  </div> <div style="text-align: justify;">Background and Aim: Providing various definitions and classifications of mental disorders has multiple scientific and practical implications. Understanding that a scientific approach to psychological concepts in the legal domain can have significant practical consequences, the present study aims to examine the attitudes of judicial authorities toward mental disorders. Method: This study employed a content analysis method, utilizing both quantitative and qualitative approaches, to examine court rulings from various levels (including trial courts, appellate courts and the Supreme Court). The statistical population consisted of all court rulings, while the study sample included rulings directly related to mental disorders and psychological concepts. Ethical Considerations: The study adhered to ethical principles, including honesty, respect for legal rights, confidentiality and the protection of intellectual and material property. Results: The results indicate that judicial authorities generally lack a complete and precise understanding of psychological concepts, exhibit both extreme and lenient attitudes toward mental disorders and hold diverse (and sometimes non-scientific) perspectives regarding the scope and boundaries of these disorders. Conclusion: The study demonstrates that judicial attitudes toward mental disorders are varied and predominantly non-scientific, often involving over- or under-interpretation of psychological concepts. Such attitudes may either broaden or limit the protection of the rights of affected individuals. Accordingly, it is recommended that mechanisms be established to ensure a more scientific and consistent approach in legal proceedings.
