fa آسیب‌شناسی سیاست جنایی ایران در قبال بزه‌های زنجیره تأمین کالاهای سلامت‌محور؛ مطالعه موردی تجهیزات پزشکی كاربردي Applicable <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">زمینه و هدف:</span></span></b> <span lang="AR-SA">تجهیزات پزشکی یکی از مهم‌ترین کالاهای سلامت‌محور است که مانند سایر کالاها، از مرحله تولید تا مصرف‌کننده نهایی، مراحل مختلفی را در زنجیره تأمین طی می‌کند. عدم نظارت بر زنجیره تأمین این تجهیزات می‌تواند سلامت جسمانی جامعه را به خطر انداخته و مشکلاتی ایجاد کند. این پژوهش با هدف بررسی چالش‌های قانونی و کیفری مرتبط با زنجیره تأمین تجهیزات پزشکی و ارائه راهکارهایی برای بهبود قوانین موجود انجام شده است.</span><span lang="FA" style="font-family:&quot;B Nazanin&quot;"></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">روش:</span></span></b> <span lang="AR-SA">این مطالعه به روش تحلیلی ـ توصیفی انجام شده است. با بررسی قوانین و مقررات مربوط به زنجیره تأمین تجهیزات پزشکی، آسیب‌های قانونی موجود شناسایی شده و نقاط ضعف بزه‌انگاری‌های مربوطه مورد تجزیه و تحلیل قرار گرفته است.</span><span lang="FA"><span style="color:black"></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">ملاحظات اخلاقی:</span></span></b> <span lang="AR-SA">این پژوهش با رعایت اصول اخلاقی پژوهش‌های حقوقی و احترام به قوانین و مقررات مربوطه انجام شده است.</span><span lang="FA"><span style="color:black"></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">یافته‌ها:</span></span></b> <span lang="AR-SA">بررسی‌ها نشان می‌دهد که قوانین کیفری مرتبط با زنجیره تأمین تجهیزات پزشکی کارآمد نبوده و همچنان با مشکلات جدی مواجه است. از جمله آسیب‌های اصلی می‌توان به نبود انسجام در جرم‌انگاری‌ها، تناسب‌نداشتن کیفرها با جرائم و عدم وجود بزه‌انگاری در برخی مراحل اشاره کرد.</span><b><span lang="FA" style="font-family:&quot;B Nazanin&quot;"></span></b></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="color:maroon">نتیجه‌گیری:</span></span></b> <span lang="AR-SA">قوانین کیفری موجود در زنجیره تأمین تجهیزات پزشکی به دلیل وجود ابهامات، تناقضات و آسیب‌های متعدد نتوانسته‌اند به اهداف خود در جلوگیری از جرائم و تخلفات دست یابند. بنابراین قانون‌گذار باید از تصویب قوانین مشابه که دارای این آسیب‌ها هستند، اجتناب کرده و به اصلاح و به‌روز‌رسانی مقررات موجود بپردازد تا زنجیره تأمین تجهیزات پزشکی کارآمدتر و ایمن‌تر شود.</span></span></span></span></span></span></div> <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="color:maroon">Background and Aim:</span></b> Medical equipment, as one of the most critical health-related commodities, undergoes several stages from production to the final consumer, similar to other goods. These stages collectively form the supply chain. The main components of this chain include production, import, export, transportation, distribution, storage and sales. Lack of supervision over the medical equipment supply chain can seriously threaten public health and create numerous problems. Accordingly, various criminalization and regulatory measures have been implemented to minimize these issues. However, due to the multiple legal shortcomings in the relevant laws, these measures have not achieved their intended goals and the problems persist. This study aims to examine the legal and criminal challenges related to the medical equipment supply chain and propose solutions to improve the current legal framework<span style="letter-spacing:-.1pt">.</span><span style="font-family:&quot;Times New Roman&quot;,serif"></span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="color:maroon">Method:</span></b> This research was conducted using an analytical and descriptive approach. By reviewing the laws and regulations related to the medical equipment supply chain, the legal gaps were identified and the weaknesses in the current criminalization and regulatory measures were analyzed<span style="letter-spacing:-.1pt">.</span><span lang="EN" style="font-family:&quot;Times New Roman&quot;,serif"></span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span lang="EN"><span style="color:maroon">Ethical Considerations:</span></span></b> This research was conducted in accordance with ethical standards for legal studies, with respect for applicable laws and regulations.</span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="color:maroon">Results:</span></b><b> </b>The findings reveal that the criminal laws concerning the medical equipment supply chain remain ineffective and continue to face significant challenges. Key issues include the lack of coherence in criminalization efforts, disproportionate penalties for certain offenses and the absence of legal provisions addressing some stages of the supply chain.</span></span><br> <span style="line-height:115%"><span style="color:black"><b><span style="line-height:115%"><span style="color:maroon">Conclusion:</span></span></b><b> </b><span style="line-height:115%">Due to ambiguities, inconsistencies and various legal shortcomings, the current criminal laws concerning the medical equipment supply chain have not been successful in preventing crimes and offenses.
