fa سلامت لوازم آرایشی و بهداشتی از منظر فقه و حقوق ایران پژوهشي Original Article <span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">زمینه و هدف:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">لوازم آرایشی و بهداشتی بخش مهمی از کالاهای مصرفی جامعه است که نقش مهمی در سلامت شهروندان دارد. هرگونه تخلف در این حیطه تأثیر زیادی بر سلامت شهروندان به همراه دارد،</span></span><span lang="FA"><span style="line-height:115%"> زیرا</span></span> <span lang="AR-SA"><span style="line-height:115%">سلامتی در مهم‌ترین بخش زندگی هر فرد قرار دارد. بر همین اساس هدف مقاله حاضر بررسی سلامت لوازم آرایشی و بهداشتی از منظر فقه و حقوق ایران است</span></span><span lang="AR-SA"><span style="line-height:115%">.</span></span><span lang="FA"><span style="line-height:115%"><span style="font-family:"B Nazanin""></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">روش: </span></span></span></b><span lang="AR-SA"><span style="line-height:115%">مقاله مورد اشاره توصیفی ـ تحلیلی بوده و از روش کتابخانه‌ای استفاده ‌شده است.</span></span><span lang="FA"><span style="line-height:115%"><span style="color:black"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">ملاحظات اخلاقی:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">در تمام مراحل نگارش پژوهش حاضر، اصالت متون، صداقت و امانتداری رعایت شده است.</span></span><span lang="FA"><span style="line-height:115%"><span style="color:black"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">یافته‌ها:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">در فقه به صورت خاص به سلامت لوازم آرایشی و بهداشتی پرداخته نشده است، اما بر سلامت افراد تأکید شده و مطابق با قواعدی چون منع اضرار و اتلاف، می‌توان قائل به نوعی ضمان و مسئولیت مدنی در این خصوص شد. در حقوق موضوعه نیز در اسناد بالادستی مانند قانون اساسی و سند چشم‌انداز بیست‌ساله و برنامه‌های پنج‌ساله توسعه بر سلامت شهروندان به صورت کلی صحه گذاشته شده است و در قوانین عادی مانند قانون مواد خوردنی و آشامیدنی آرایشی و بهداشتی مصوب </span></span><span lang="FA"><span style="line-height:115%">۱۳۴۶ و اصلاحیه‌های بعدی آن و پیش‌نویس قانون تعزیرات مصوب 1401 به نظارت بر تولید و توزیع لوازم آرایشی و بهداشتی پرداخته شده و برای متخلفان مجازات تعیین شده است</span></span><span lang="AR-SA"><span style="line-height:115%">.</span></span><b><span lang="FA"><span style="line-height:115%"><span style="font-family:"B Nazanin""></span></span></span></b></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">نتیجه‌گیری:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">با توجه به مصادیق تقلب اشخاص درگیر در این زمینه و گستره‌ای وسیع آن، تدوین قانونی خاص برای لوازم آرایشی و بهداشتی، ضرورت فزاینده‌ای دارد.</span></span></span></span></span></span></span><br> &nbsp; <span style="font-family:Tahoma;"><span style="font-size:12px;"><span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%"><span style="color:maroon">Background and Aim:</span></span></b> <span style="line-height:115%">Cosmetics and health products are an important part of society&#39;s consumer goods that play an important role in the health of citizens. Any violation in this area has a great impact on the health of citizens, because health is the most important part of every person&#39;s life.Accordingly, the aim of the present article is to examine the health of cosmetics and health products from the perspective of Iranian jurisprudence and law.</span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%"><span style="color:maroon">Method:</span></span></b><span style="line-height:115%"> The article in question is descriptive-analytical and the library method was used<span style="letter-spacing:-.1pt">.</span></span><b><span lang="X-NONE"><span style="line-height:115%"><span style="font-family:"Times New Roman",serif"></span></span></span></b></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span lang="EN"><span style="line-height:115%"><span style="color:maroon">Ethical Considerations:</span></span></span></b> <span style="line-height:115%">In all stages of writing this research, the originality of the texts, honesty and trustworthiness have been observed.</span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%"><span style="color:maroon">Results:</span></span></b><b> </b><span style="line-height:115%">The health of cosmetics and health products has not been specifically addressed in jurisprudence, but the health of individuals has been emphasized and in accordance with rules such as the prevention of harm and waste, a kind of guarantee and civil liability can be considered in this regard. In statutory law, in upstream documents such as the Constitution, the Twenty-Year Vision Document and the Five-Year Development Plans, citizens&#39; health has been generally endorsed and in ordinary laws such as the Food, Beverage, Cosmetics and Hygiene Law of 1346 and its subsequent amendments and the draft Penal Code of 1401, the production and distribution of cosmetics and hygiene products have been monitored and penalties have been determined for violators.</span></span></span><br> <span style="line-height:115%"><span style="color:black"><b><span style="color:maroon">Conclusion:</span></b><b> </b>Considering the examples of fraud by individuals involved in this field and its wide scope, there is an increasing need to formulate a specific law for cosmetics and hygiene products.</span></span><br> <br> <span style="line-height:115%"><b><span style="line-height:115%">Please cite this article as:</span></b></span><br> <span style="line-height:107%">Pourmollaei M, Raisi R.
