fa تحلیل فقهی و حقوقی بر مسئولیت کیفری بیماران بدن‌نما با توجه به دیدگاه مصلحت‌شناسی Jurisprudential and Legal Analysis of the Criminal Liability of Overweight Patients with Regard to the Expediency Perspective پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: بیماری بدن‌نمایی نوعی اختلال روانی محسوب می‌شود که فرد بیمار اعضای شخصی بدن خود را برای عموم به نمایش می‌گذارد و از این اقدام لذت می‌برد. این عمل برخلاف عرف و اخلاق بوده و به ارزش‌های اجتماعی زیان وارد می‌نماید. روش: در این پژوهش با استفاده از روش توصیفی ـ تحلیلی دیدگاه‌های فقهی مصلحت‌شناسی و همچنین حقوقی در خصوص موضوع پژوهش بیان شده و بر اساس آن، پیشنهاد اصلاح قوانین در این حوزه ارائه ‌شده است. ملاحظات اخلاقی: در تمامی مراحل نگارش، مطابق با اصول تحقیق عمل گردید. یافته‌ها: در خصوص لزوم اعمال مجازات بر این افراد و کیفیت آن، اختلاف ‌نظر فراوان وجود دارد. برخی از حقوقدانان معتقد به مجازات این بیماران می‌باشند و برخی دیگر این افراد را مستحق معافیت از مجازات می‌دانند. به عقیده موافقان، این افراد دارای قوه تمییز بوده و می‌بایست بر آنان حد اعمال گردد. مخالفان معتقدند که این عمل غیر ارادی بوده و در شمول موارد معافیت از مسئولیت کیفری قرار دارد. هدف این پژوهش بررسی فقهی و حقوقی مسئولیت کیفری این بیماران، با تمرکز بر مباحث مصلحت‌شناسانه می‌باشد. نتیجه‌گیری: نتیجه نهایی اینکه برخلاف دیدگاه‌های حقوق غربی و همچنین دیدگاه برخی علمای اهل سنت، بیماری عورت‌نمایی با وجود تلقی‌شدن به عنوان نوعی بیماری روانی، موجب زوال قوه تمییز نشده و با عمیق‌نمودن خلأهای روحی، موجب لذت‌بردن فرد بیمار از این اقدام می‌گردد. بنابراین عدم ‌تشخیص کراهت این عمل توسط بیمار به معنای زوال قوه تمییز نبوده و عناصر شاکله جرم برای آن متصور است، لذا می‌بایست بر وی مجازات اعمال گردد. حسب نظر برخی فقهای اهل سنت و همچنین نظر مصلحت‌شناسی، این افراد می‌بایست در تبعید به سر برده تا جامعه از تجاوز روانی آن‌ها در امان باشد و اگر در دوران تبعید چنین اقدامی انجام دهند، مجازات بر آن‌ها وارد است. با این‌ حال حبس در آسایشگاه روانی برای این بیماران به صلاح نمی‌باشد.</div> <div style="text-align: justify;">Background and Aim: Body exhibitionism is a type of mental disorder in which the patient displays his or her private parts to the public and enjoys this act. This act is against custom and morality and harms social values. Method: In this study, using a descriptive-analytical method, jurisprudential and legal perspectives on the subject of the research are expressed, and based on this, a proposal for amending the laws in this area is presented. Ethical Considerations: In all stages of writing, the research principles were followed. Results: There is a great deal of disagreement regarding the necessity of imposing punishment on these individuals and its quality. Some jurists believe in punishing these patients, while others consider them to be deserving of exemption from punishment. According to those in favor, these individuals have the power of discernment and the hadd should be imposed on them. Opponents believe that this act was involuntary and is included in cases exempt from criminal liability. The purpose of this study is to examine the jurisprudence and legality of the criminal liability of these patients, focusing on expediency issues. Conclusion: The final conclusion is that, contrary to the views of Western law and the views of some Sunni scholars, the disease of nudity, despite being considered a type of mental illness, does not cause the deterioration of the power of discernment and, by deepening the spiritual gaps, causes the patient to enjoy this act. Therefore, the patient's failure to recognize the abomination of this act does not mean the deterioration of the power of discernment and the elements of the crime are conceivable for it, so punishment should be imposed on him. According to some Sunni jurists and also from the perspective of expediency, these individuals should be exiled so that society is safe from their psychological aggression, and if they commit such an act during exile, punishment will be imposed on them.
