fa مبانی مسئولیت مدنی ناشی از بهره‌گیری از ربات جراح هوشمند در عمل‌های جراحی Basics of Civil Liability due to the Use of Intelligent Surgeon Robot in Surgical Procedures پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: مهندسی پزشکی تحت تأثیر تحولات فناوری، به شکل مداوم دستاوردهای جدیدی را به نظام درمانی عرضه می‌دارد. تحت تأثیر رشد فزاینده هوش مصنوعی یکی از این هدایا بهره‌گیری از هوش مصنوعی در جراحی می‌باشد. ربات هوشمند جراح با غلبه بر محدودیت‌ها و ضعف‌های انسانی می‌تواند شرایطی را فراهم سازد که عمل جراحی با تهاجم کمتر، تخریب کمتر و دقت بالاتری انجام پذیرفته و نتایج بهتری را برای این حوزه پزشکی به ارمغان آورد. با وجود این همانند هر تحول دیگری از زندگی اجتماعی، این فناوری نیز باید تحت پوشش قواعد حقوقی قرار گیرد. یکی از حوزه‌های چالش‌برانگیر حقوقی مبانی مسئولیت مدنی است که باید برای این سیستم جراحی درنظر گرفته شود. این تحقیق به شیوه توصیفی ـ تحلیلی به بررسی چیستی این فناوری و چالش‌های اعمال هر یک از نظریات مسئولیت مدنی برای پوشش آن پرداخته است. روش: این تحقیق از نوع نظری بوده و روش تحقیق به صورت توصیفی ـ تحلیلی است و روش جمع‌آوری اطلاعات به صورت کتابخانه‌ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است. ملاحظات اخلاقی: در تحقیق حاضر، اصل امانتداری، صداقت، بی‌طرفی و اصالت اثر رعایت شده است. یافته‌ها: جامعه حقوقی نیازمند خلق مبانی جدیدی برای انطباق با فناوری‌های مبتنی بر هوش مصنوعی است. نتیجه‌گیری: مقاله حاضر نتیجه می‌گیرد نظریه‌های مسئولیت مدنی با چالش‌های جدی برای پوشش این فناوری مواجه هستند، البته در این میان نظریه مسئولیت مبتنی بر فرض تقصیر تا حدود بیشتری می‌تواند با آن منطبق باشد.  </div> <div style="text-align: justify;">Background and Aim: Under the influence of technological developments, medical engineering continuously offers new achievements to the medical system. Under the influence of the increasing growth of artificial intelligence, one of these gifts is the use of artificial intelligence in surgery. By overcoming human limitations and weaknesses, the intelligent surgeon robot can provide conditions where surgery is performed with less invasiveness, less destruction and higher accuracy and bring better results to this field of medicine. However, like any other evolution of social life, this technology must also be covered by legal rules. One of the challenging legal areas is the basics of civil liability that should be considered for this surgical system. In a descriptive-analytical way, this research has investigated what this technology is and the challenges of applying each of the theories of civil responsibility to cover it. Method: This research is of a theoretical type and the research method is descriptive-analytical and the method of collecting information is library and it was done by referring to documents, books and articles. Ethical Considerations: In this research, the principles of trustworthiness, honesty, impartiality and originality of the work have been observed. Results: The legal community needs to create new foundations to adapt to artificial intelligence-based technologies. Conclusion: The present article concludes that theories of civil responsibility face serious challenges to cover this technology. Of course, in the meantime, the theory of responsibility based on the assumption of fault can be consistent with it to a greater extent.
