fa مسئولیت کیفری اشخاص دارای اختلال اراده در آسیب به جنین Crimical Responsibility of Individuals with Willpower Disorders in Harming the Fetus پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: ممکن است اشخاصی که به نحوی به مشکلات روحی دچار می‌باشند، نسبت به رابطه عاطفی با شریک جنسی خود اقدام نمایند. شدت هیجان در این اشخاص به نحوی است که محتملاً در اوج لذت، به شریک خود آسیب وارد نموده و در صورت بارداری زن، احتمال سقط جنین وجود دارد. در این پژوهش هدف آن است که مسئولیت حقوقی این نوع رفتار غیر ارادی مورد مطالعه قرار گیرد. روش: روش پژوهش به صورت تحلیلی ـ توصیفی و ابزار جمع‌آوری اطلاعات فیشبرداری می‌باشد. ملاحظات اخلاقی: در نگاشت این پژوهش تمامی مسائل اخلاقی مرتبط با روش تحقیق رعایت گردید. یافته‌ها: فقدان اراده و ارتکاب افعال به صورت ناخودآگاه، به موجب ماده 149 قانون مجازات اسلامی، مستوجب مجازات نخواهد بود، اما اگر در لحظه هوشیاری به عاقبت این عمل آگاه بوده و نسبت به برقراری رابطه اقدام نماید، تصمیم اصلی در زمان هوشیاری اتخاذ گردیده است. نتیجه‌گیری: چنین نتیجه شد که اگر در حالت هوشیاری تصمیمی اتخاذ گردد که به دوران فقدان تمییز، اراده، اختیار و عقل مرتبط باشد، این مهم نمی‌تواند موجب برخورداری از مزایای ماده 149 مجازات اسلامی‌گردد. این مهم در تفسیر موسع مواد 153 و 154 مشهود می‌باشد. بنابراین اختلال اراده در لحظه برقراری رابطه عاطفی نمی‌تواند عاملی برای رفع مجازات محسوب گردد. از دیدگاه حقوق مدنی نیز مسئولیت مدنی مرتکب به قوت خود پابرجا بوده و امکان انتساب آن به عاقله وجود ندارد، لذا حتی به فرض زائل‌شدن عناصر مخدوش‌کننده مسئولیت کیفری، بازهم مسئولیت جبران خسارت به قوت خود باقی خواهد ماند.  </div> <div style="text-align: justify;">Background and Aim: Individuals who suffer from mental health problems may engage in emotional relationships with their sexual partners. The intensity of emotion in these individuals is such that they are likely to harm their partner at the height of pleasure and, if the woman becomes pregnant, there is a possibility of miscarriage. The aim of this study is to study the legal responsibility of this type of involuntary behavior. Method: The research method is analytical-descriptive and the data collection tool is questionnaire. Ethical Considerations: All ethical issues related to the research method were observed in the design of this study. Results: Lack of will and committing acts unconsciously will not be punishable under Article 149 of the Islamic Penal Code. However, if at the moment of consciousness one is aware of the consequences of this act and acts to establish a relationship, the main decision has been made at the time of consciousness. Conclusion: It was concluded that if a decision is made in a state of consciousness that is related to the period of lack of discrimination, will, authority and reason; this cannot lead to the enjoyment of the benefits of Article 149 of the Islamic Penal Code. This is evident in the broad interpretation of Articles 153 and 154. Therefore, the disorder of will at the moment of establishing an emotional relationship cannot be considered a factor for removing the punishment. From the perspective of civil law, the perpetrator's civil liability remains in its own right and cannot be attributed to a sane person. Therefore, even if the elements that distort criminal liability are eliminated, the liability for compensation will still remain in its own right.
