fa الگوی قانونگذاری کشورهای عضو بریکس در مواجهه با وضعیت اضطراری ناشی از بحران کرونا The Legislative Pattern of BRICS Member Countries in Facing the Emergency Situation Caused by the Corona Crisis پژوهشي Original Article زمینه و هدف: ظهور و شیوع بیماری کرونا را می‌توان مصداقی بارز از ایجاد وضعیت اضطراری محسوب کرد که از مهم‌ترین آثار و پیامدهای حقوقی آن، تغییر و تحول الگوی قانونگذاری برخی کشورها در مواجهه با این وضعیت، به منظور مدیریت و تمشیت بهتر و کارآمدتر امور است، چراکه به نظر می‌رسد با الگوهای قانونگذاری عادی و مرسوم، نتوان این وضعیت اضطراری را مدیریت نمود. سؤال اصلی مورد پژوهش آن است که الگوی قانونگذاری در کشورهای عضو بریکس در مواجهه با وضعیت اضطراری ناشی از کرونا چه بوده و از منظر مقایسه‌ای، چه شباهت‌ها و تفاوت‌هایی در این زمینه قابل ذکر است؟ روش: در تحقیق حاضر که با روش توصیفی ـ تحلیلی نگاشته شده، کوشش شده است الگوهای قانونگذاری در کشورهای عضو گروه بریکس، در مواجهه با این وضعیت در این کشورها مورد بررسی قرار گیرد. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، اصالت متون، صداقت و امانتداری رعایت شده است. یافته‌ها: نتیجه حاصل از این مطالعه نشان می‌دهد که کشورهای مزبور، سیاست‌های رفتاری متنوع و متفاوتی را برای مدیریت شرایط اضطراری ناشی از کرونا به کار گرفته‌اند و نظامات قانونگذاری متنوعی را اجرا نموده‌اند که می‌توان آن‌ها را ذیل سه عنوان «نظام جبران»، «نظام انطباق» و «نظام تلفیقی بازدارنده» بازشناسی کرد. نتیجه‌گیری: هرچند این نظام‌ها هم در ماهیت و هم در ساختارهای مورد استفاده و هم در نحوه کاربست، با یکدیگر متفاوت هستند؛ تجارب موجود در این میان می‌تواند به برون‌رفت از بحران‌های ناشی از وضعیت‌های اضطراری بینجامد.   Background and Aim: The emergence and spread of the Corona disease can be considered a clear example of creating an emergency situation, one of the most important effects and legal consequences of which is the change and evolution of the legislative pattern of some countries in facing this situation, in order to manage and regulate affairs better and more efficiently, because it seems that this emergency situation cannot be managed with normal and conventional legislative patterns. Method: In the present study, which was written using a descriptive-analytical method, an attempt has been made to examine the legislative patterns in the BRICS member countries in facing this situation in these countries. Ethical Considerations: In all stages of writing the present research, the originality of the texts, honesty and trustworthiness have been observed. Results: The results of this study show that the aforementioned countries have adopted diverse and different behavioral policies to manage the emergency situation caused by the Corona and have implemented diverse legislative systems that can be recognized fewer than three headings: "compensation system", "adaptation system" and "integrated deterrent system". Conclusion: Although these systems differ from each other in nature, in the structures used and in the way they are applied; the experiences in between can lead to a way out of crises resulting from emergency situations.
