fa مسئولیت حقوقی خطای هوش مصنوعی در اعمال پزشکی در نظام‌های حقوقی ایران و عراق پژوهشي Original Article <p dir="RTL"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">زمینه و هدف:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">فناوری هوش مصنوعی در حوزه‌های مختلف کاربرد داشته و با وجود کارآیی نسبتاً موفق، امکان خطای عملکردی آن وجود دارد. با توجه به اهمیت جان انسان‌ها، کاربرد این فناوری در حوزه سلامت بسیار محتاطانه پیش رفته و تا زمان اطمینان نسبتاً کامل به موفقیت آن، مجوز استفاده از آن صادر نمی‌گردد. هدف پژوهش بررسی مسئولیت حقوقی خطای هوش مصنوعی در اعمال پزشکی در دو نظام حقوقی ایران و عراق می‌باشد</span></span><span lang="AR-SA"><span style="line-height:115%">.<span style="font-family:&quot;B Nazanin&quot;"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">روش: </span></span></span></b><span lang="AR-SA"><span style="line-height:115%">این پژوهش به روش تحلیلی ـ توصیفی انجام ‌شده و در غیاب منبع حقوقی خاص این حوزه، قواعد عام حقوقی از دو جنبه مدنی و کاربردی، به این مورد تعمیم داده شده است</span></span><span lang="AR-SA"><span style="line-height:115%">.</span></span><span lang="FA"><span style="line-height:115%"><span style="color:black"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">ملاحظات اخلاقی:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">در تمامی مراحل نگارش، مطابق با اصول تحقیق عمل گردید.</span></span><span lang="FA"><span style="line-height:115%"><span style="color:black"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">یافته‌ها:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">در نظام حقوقی عراق، امکان مطالبه تمامی خسارت‌های مرتبط با ایراد جنایت وجود دارد. مسئولیت تولیدکننده، ناظر کیفی، مسئول نگهداری و کاربر مستقیم فناوری، بر اساس سهم آن‌ها در بروز خطا شناسایی ‌شده و هر یک به نوبه خود مسئول جبران خسارت خواهند بود. در کشور ما امکان برخورد قانونی با شخص حقوقی وجود داشته و در کشور عراق دامنه اختیارات نظام قضایی تنها به کاربر مستقیم و رییس هیأت‌مدیره شرکت محدود می‌باشد که این عملکرد مورد انتقاد است</span></span><span lang="AR-SA"><span style="line-height:115%">.</span></span><b><span lang="FA"><span style="line-height:115%"><span style="font-family:&quot;B Nazanin&quot;"></span></span></span></b></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">نتیجه‌گیری:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">نتیجه نهایی اینکه در ادبیات حقوق کیفری کشور ما نهاد بی‌مبالاتی تعریف ‌نشده و تا زمان ذکر صریح مصداق آن در منابع حقوقی، امکان برخورد با متخطیان وجود ندارد. بنابراین برخورد با خاطیان حوزه مورد مطالعه، تنها به دیه و جبران خسارت محدود می‌باشد، اما در نظام حقوقی عراق خطای فاحش مسببین، می‌تواند مستوجب مجازات تعزیری باشد. به موجب قواعد حقوق کیفری، خسارت جانی تنها در چهارچوب دیه جبران شده و ضامن بر مسئولیت مدنی می‌باشد.<span style="font-family:&quot;B Nazanin&quot;"></span></span></span></span></span></span></span></span><br> &nbsp;</p> <p style="text-align: justify;"><span style="font-family:Tahoma;"><span style="font-size:12px;"><span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%"><span style="color:maroon">Background and Aim:</span></span></b> <span lang="EN"><span style="line-height:115%">Artificial intelligence technology is effective in various fields and despite its relatively successful effectiveness, there is a possibility of its functional error. Given the importance of human life, the application of this technology in the field of health is very cautious and until it is relatively certain of its success, a license for its use is not issued. According to the rules of criminal law, personal injury is only compensated within the framework of blood money and guarantees civil liability, while in the Iraqi legal system, it is possible to claim all damages related to the crime. The liability of the manufacturer, quality supervisor, maintenance manager and direct user of the technology is identified based on their share in the error and each will be responsible for compensation. In our country, it is possible to legally deal with a legal entity and in Iraq, the scope of the judicial system&#39;s authority is limited only to the direct user and the chairman of the board, which is criticized</span></span><span style="line-height:115%">.</span></span></span><br> <span style="line-height:115%"><span style="color:black"><b><span style="line-height:115%"><span style="color:maroon">Conclusion:</span></span></b><b> </b><span lang="EN"><span style="line-height:115%">The final result is that the institution of negligence is not defined in the criminal law literature of our country and until its instance is explicitly mentioned in legal sources, there is no possibility of dealing with the violator.
