fa «الزامات» و «معیارهای» قانونگذاری در حوزه فناوری سلول‌های بنیادی با تکیه بر رویکردهای تقنینی اتحادیه اروپا Legislative "Requirements" and "Criteria" in the Field of Stem Cell Technology Based on European Union Legislation پژوهشي Original Article زمینه و هدف: توسعه فناوری نوین سلول درمانی که محصول تحقیقات بر روی سلول‌های بنیادی از اوایل دهه 1980 بوده، علیرغم ایجاد افق‌های جدید پیش‌ روی بهبود و ارتقای سطح کیفیت حیات بشر، مسائل و چالش‌های حقوقی و اخلاقی مختلفی را در نوع استفاده، محدوده کاربردهای آن و به طور کلی مشروعیت تحقیقات بر روی انسان مطرح کرده است. دانشمندان، سلول‌های بنیادی را بر اساس خصوصیات و ویژگی به سه دسته سلول‌های بنیادی جنینی، سلول‌های بنیادی بالغ و سلول‌های بنیادی خون بند ناف تقسیم می‌کنند. روش: این مقاله با روش تحلیلی ـ تطبیقی و با تکیه بر اصول حقوقی به دنبال ارائه الگوی مناسب جهت قانونگذاری فناوری سلول‌های بنیادی بوده که اصول اخلاق زیستی به مثابه «الزامات» و رهیافت‌های سند ملی علوم و فناوری سلول‌های بنیادی به عنوان «معیارهای» آن در نظر گرفته شده است. ملاحظات اخلاقی: کشورهای اتحادیه اروپا با توجه به جوانب اخلاق زیستی و اصول حقوقی، رویکرد تقنینی متفاوتی را در استفاده و تحقیق بر روی این سلول‌ها اتخاذ کرده‌اند. همچنین برخی اسناد و دستورالعمل‌های اتحادیه اروپا دربردارنده برخی مقررات در خصوص هنجارسازی این حوزه از فناوری زیست‌پزشکی است. یافته‌ها: در یک تقسیم‌بندی کلی برخی از کشورهای اتحادیه استفاده و تحقیق را ممنوع، برخی نیز محدودیت‌هایی اعمال کرده و دسته‌ای از کشورها نیز قوانین موضوعه صریح نداشته و یا اصلاً به سمت هنجارسازی سلول‌های بنیادی نرفته‌اند. ایران به عنوان یکی از کشورهای پیشرفته در حوزه فناوری سلول‌های بنیادی با خلأ قانونگذاری در این زمینه مواجه است، حال اینکه ضرورت هنجارسازی بایستی موازی با توسعه این فناوری باشد. نتیجه‌گیری: تدوین و تصویب قانونی جامع، چندبُعدی و بومی‌شده در زمینه فناوری سلول‌های بنیادی یک ضرورت اجتناب‌ناپذیر است؛ قانونی که ضمن بهره‌گیری از الگوهای موفق بین‌المللی مانند مقررات اتحادیه اروپا، به اصول بنیادین اخلاق زیستی، ملاحظات فقهی و فرهنگی ایران و الزامات سند ملی علوم و فناوری سلول‌های بنیادی وفادار باشد.   Background and Aim: The development of new cell therapy technology, which has been the product of stem cell research since the early 1980s, despite creating new horizons for improving and enhancing the quality of human life, has raised various legal and ethical issues and challenges in the type of use, the scope of its applications, and the legitimacy of research on humans in general. Scientists divide stem cells into three categories based on their characteristics and properties: embryonic stem cells, adult stem cells, and cord blood stem cells. Method: This article, using an analytical-comparative method and relying on legal principles, seeks to provide a suitable model for legislating stem cell technology, in which bioethical principles are considered as "requirements" and the approaches of the National Stem Cell Science and Technology Document as its "criteria". Ethical Considerations: EU countries have adopted a different legislative approach to the use and research on these cells, considering the aspects of bioethics and legal principles, and some EU documents and guidelines also contain some regulations regarding the standardization of this field of biomedical technology. Results: In a general classification, some EU countries prohibit the use and research, some have imposed restrictions, and a group of countries do not have explicit laws or have not moved towards the standardization of stem cells at all. Iran, as one of the advanced countries in the field of stem cell technology, faces a legislative vacuum in this field. However, the necessity of standardization should be parallel to the development of this technology. Conclusion: The development and approval of a comprehensive, multidimensional, and localized law in the field of stem cell technology is an inevitable necessity; A law that, while utilizing successful international models such as European Union regulations, is faithful to the fundamental principles of bioethics, Iranian jurisprudential and cultural considerations, and the requirements of the National Stem Cell Science and Technology Document.
