fa جرم‌شناسی عصب‌شناختی: مفاهیم پایه، چهارچوب‌های نظری و دلالت‌های عملی Neurocriminology: Basic Concept, Theoretical Frameworks and Practical Implications پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: جرم‌شناسی عصب‌شناختی، یک حوزه میان‌رشته‌ای نوظهور است که علوم اعصاب، روان‌شناسی و جرم‌شناسی را برای بررسی مبانی زیستی و عصبی رفتارهای مجرمانه تلفیق می‌کند. این مقاله مروری بر مفاهیم پایه‌ای، چهارچوب‌های نظری و دلالت‌های کاربردی جرم‌شناسی عصب‌شناختی ارائه می‌دهد و به تبیین چیستی، اهمیت و چالش‌های کلیدی این حوزه می‌پردازد. مطالعه حاضر ابتدا ماهیت و ضرورت جرم‌شناسی عصب‌شناختی را بررسی می‌کند و توضیح می‌دهد که چرا این حوزه در درک رفتار مجرمانه، فراتر از رویکردهای سنتی جامعه‌شناختی و روان‌شناختی، اهمیت یافته است، سپس ویژگی‌های متمایزکننده این دانش را برمی‌شمارد و بر روش‌های عصب‌شناختی مانند تصویربرداری مغزی، مطالعات ژنتیکی و ارزیابی‌های عصب‌روان‌شناختی تأکید می‌کند. در ادامه، مقاله تعریف دقیقی از جرم‌شناسی عصب‌شناختی ارائه می‌دهد و آن را از رشته‌های مرتبط متمایز می‌سازد، در حالی‌ که بر دستاوردهای منحصر به فرد آن در پژوهش‌های جرم‌شناسی تأکید دارد، سپس اهمیت جرم‌شناسی عصب‌شناختی را مورد بحث قرار می‌دهد، به ‌ویژه در ارتقای راهبردهای پیشگیری از جرم، اصلاح مداخلات قضایی و توان‌بخشی و روشنگری مباحث اخلاقی درباره اختیار و مسئولیت کیفری. در نهایت، مقاله به مسائل و چالش‌های کلیدی در جرم‌شناسی عصب‌شناختی می‌پردازد، از جمله نگرانی‌های اخلاقی، محدودیت‌های روش‌شناختی و احتمال سوءاستفاده از یافته‌های عصب‌شناختی در نظام عدالت کیفری. این نوشتار با ترکیب پژوهش‌های موجود، درک پایه‌ای از جرم‌شناسی عصب‌شناختی را ارائه می‌دهد و گامی به سوی گفتگوهای علمی و کاربردی بیشتر در این حوزه رو به رشد محسوب می‌شود. روش: پژوهش حاضر از نوع نظری به روش توصیفی ـ تحلیلی است. روش جمع‌آوری اطلاعات آن به صورت کتابخانه‌ای با مراجعه به اسناد، کتب و مقالات است. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر ضمن رعایت اصالت متون صداقت و امانتداری رعایت شده است. یافته‌ها: یافته اصلی مقاله آن است که جرم‌شناسی عصب‌شناختی با تلفیق علوم اعصاب و جرم‌شناسی سنتی، امکان فهم ژرف‌تری از علل زیستی بزهکاری فراهم می‌سازد. با این حال، به کارگیری این دانش مستلزم ملاحظات اخلاقی و حقوقی جدی درباره مسئولیت کیفری و حدود برنامه‌های پیشگیری و مداخله‌ای است. نتیجه‌گیری: در نتیجه، جرم‌شناسی عصب‌شناختی به عنوان رویکردی نوین، ظرفیت‌های مهمی برای تحول در فهم، پیشگیری و واکنش به بزهکاری فراهم می‌سازد و با تمرکز بر مکانیسم‌های مغزی و زیستی، افق‌های تازه‌ای را پیش روی مطالعات جرم‌شناختی می‌گشاید. با این حال، بهره‌گیری از این دانش باید با احتیاط و در پرتو اصول حقوقی و اخلاقی صورت گیرد، چراکه تکیه‌ صرف بر تبیین‌های زیستی می‌تواند به نادیده‌گرفتن عوامل اجتماعی، روانی و فرهنگی منجر شود و مفهوم مسئولیت فردی را به چالش بکشد. بنابراین توسعه این حوزه مستلزم رویکردی جامع، انتقادی و مبتنی بر موازنه میان علم و ارزش‌های بنیادین حقوق کیفری است.  </div> <div style="text-align: justify;">Background and Aim: Neurocriminology is an emerging interdisciplinary field that integrates neuroscience, psychology and criminology to explore the biological and neural underpinnings of criminal behavior. This article provides an overview of the fundamental concepts, theoretical frameworks and practical implications of neurocriminology, addressing its nature, significance and key challenges.  The study first examines the essence and rationale of neurocriminology, explaining why this field has gained prominence in understanding criminal behavior beyond traditional sociological and psychological approaches. It then outlines the defining characteristics of neurocriminology, emphasizing its reliance on neuroscientific methods such as brain imaging, genetic studies and neuropsychological assessments.  Next, the article presents a precise definition of neurocriminology, distinguishing it from related disciplines while highlighting its unique contributions to criminological research. The discussion then shifts to the importance of neurocriminology, particularly in enhancing crime prevention strategies, refining legal and rehabilitative interventions and informing ethical debates on free will and responsibility. Finally, the article explores key issues and challenges in neurocriminology, including ethical concerns, methodological limitations and the potential misuse of neuroscientific findings in criminal justice. By synthesizing current research, this paper aims to provide a foundational understanding of neurocriminology while encouraging further scholarly and practical engagement with this evolving field. Method: The present study is of a theoretical type using a descriptive-analytical method. The method of collecting information is library-based, referring to documents in books and articles. Ethical Considerations: Throughout all stages of writing this research, honesty and trustworthiness have been observed, while respecting the originality of the texts. Results: The study's central conclusion demonstrates that neurocriminology provides a more profound comprehension of the biological underpinnings of criminality through its synthesis of neuroscience and conventional criminology. Nevertheless, the practical implementation of this discipline necessitates rigorous ethical and legal deliberations concerning criminal liability and the parameters of prevention and intervention initiatives. Conclusion: Neurocriminology, as an emerging interdisciplinary approach, offers significant potential to transform our understanding, prevention and response to criminal behavior. By focusing on neural and biological mechanisms, it opens new horizons for criminological research. However, the application of this knowledge must be undertaken cautiously within legal and ethical frameworks, as overreliance on biological explanations risks neglecting crucial social, psychological and cultural factors, while potentially undermining fundamental concepts of individual responsibility. Consequently, the advancement of this field demands a comprehensive, critical approach that maintains equilibrium between scientific progress and core principles of criminal justice.
