fa بررسی فقهی و حقوقی امکان استفاده از انرژی هسته‌ای در حذف اجزای اضافه بدن A Jurisprudential and Legal Study of the Possibility of Using Nuclear Energy to Remove Excess Body Parts پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: در دهه گذشته، استفاده از فناوری محدود هسته‌ای برای حذف قسمت‌های اضافی بدن مرسوم شده و از یکسو ناقض آیین‌نامه‌های وزارت بهداشت می‌باشد و از سوی دیگر با عدم مخالفت سازمان نظام‌پزشکی رو به رو بوده است. در این پژوهش ماهیت فقهی و حقوقی استفاده از این روش مورد مطالعه قرار گرفته است. روش: این پژوهش به روش تحلیلی ـ توصیفی انجام ‌شده و هدف اصلی تبیین ماهیت فقهی و حقوقی در استفاده از فناوری هسته‌ای برای حذف اجزای اضافه می‌باشد. ملاحظات اخلاقی: در تمامی مراحل نگارش، مطابق با اصول تحقیق عمل گردید. یافته‌ها: در جمع‌بندی مطالب فقهی و همچنین تفسیر موسع آیین‌نامه‌های مرتبط با پزشکی هسته‌ای، استفاده از فناوری هسته‌ای که به ‌نوعی موجب سوزاندن اجزای اضافه می‌گردد، دارای منع قانونی بوده که در خلأ قوانین موضوعه و مقررات اجرایی مقتضی، موجب رواج استفاده از این روش گردیده است. در اکثریت کشورهای غربی نیز استفاده از این روش ممنوع می‌باشد و جواز صادرات تجهیزات آن به دیگر کشورها محل سؤال است. بنابراین در استفاده از این روش می‌بایست منع قانونی در نظر گرفت. نتیجه‌گیری: نتیجه نهایی اینکه در غیاب مسئولیت خاص وزارت بهداشت، امورات پزشکی هسته‌ای دارای ابهامات فراوانی بوده و در غیاب اقدامات مقتضی وزارت بهداشت، اکنون این روش در بخش خصوصی به کار گرفته‌ شده و قانوناً امکان برخورد با متخلفین وجود ندارد. نیاز است که در مقام رفع خلأ آیین‌نامه‌های سازمان پزشکی قانونی و وزارت بهداشت، استفاده از این فناوری در حذف اجزای اضافه بدن، در تمامی بخش‌های دولتی و خصوصی ممنوع اعلام گردد.</div> <div style="text-align: justify;">Background and Aim: In the past decade, the use of limited nuclear technology to remove excess body parts has become common and on the one hand, it is incomplete in the regulations of the Ministry of Health and on the other hand, it has been met with a lack of opposition from the Medical System Organization. In this study, the jurisprudential and legal nature of using this method has been studied. Method: This study was conducted using an analytical-descriptive method and attempted to explain the true legal nature of using nuclear technology to remove excess body parts. Ethical Considerations: In all stages of writing, the research principles were followed. Results: In summarizing the jurisprudential material, as well as the extensive interpretation of the regulations related to nuclear medicine, the use of nuclear technology, which in some way causes the burning of excess parts, has a legal prohibition, which has led to the widespread use of this method in the absence of applicable laws and appropriate executive regulations. In most Western countries, the use of this method is also prohibited and the export of its equipment to other countries is questionable. Therefore, legal prohibition should be considered in the use of this method. Conclusion: The final conclusion is that in the absence of the specific responsibility of the Ministry of Health, nuclear medicine affairs have many ambiguities and in the absence of appropriate measures by the Ministry of Health, this method is now used in the private sector and there is no legal possibility of dealing with violators. It is necessary to close the gap in the regulations of the Forensic Medicine Organization and the Ministry of Health and to prohibit the use of this technology in the removal of excess body parts in all public and private sectors.
