fa مسئولیت مدنی ناشی از تحقیقات انسانی در حقوق ایران و آمریکا Civil Liability Resulting from Human Subject Research in Iranian and America's Law پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: پژوهش‌های پزشکی بر روی انسان، علیرغم نقش اساسی در پیشرفت دانش، همواره با خطرات جسمی، روانی، مالی و حیثیتی برای آزمودنی‌ها همراه است. مراکز تحقیقاتی انسانی به عنوان بازیگران اصلی در طراحی، اجرا و نظارت بر این مطالعات، مسئولیت مدنی ویژه‌ای در پیشگیری و جبران آسیب‌ها دارند. این مقاله با رویکرد تطبیقی به بررسی ماهیت، مبانی و سازوکارهای مسئولیت مدنی این مراکز در نظام حقوقی ایران و ایالات متحده می‌پردازد و به دنبال تبیین تفاوت‌ها، شباهت‌ها و چالش‌های عملی در جبران خسارت است. روش: این پژوهش به صورت کیفی و با رویکرد توصیفی ـ تحلیلی، بر پایه منابع اسنادی و کتابخانه‌ای حقوق ایران و آمریکا انجام شده است. ملاحظات اخلاقی: در پژوهش حاضر، اصل امانتداری، صداقت، بی‌طرفی و اصالت اثر رعایت شده است. یافته‌ها: حمایت مؤثر از آزمودنی‌ها در آمریکا مستلزم بیمه اجباری و نظام جبران واحد و در ایران نیازمند تقویت ضمانت اجرا و جبران مبتنی بر خطر است. نتیجه‌گیری: بررسی تطبیقی نشان می‌دهد که هرچند هر دو نظام ایران و آمریکا مسئولیت مدنی مراکز تحقیقاتی انسانی را عمدتاً بر مبنای تقصیر می‌پذیرند، در عمل رویکردها و میزان حمایت از آزمودنی‌ها متفاوت است. ایران از نظر متون قانونی و راهنماهای اخلاقی پوشش جبران خسارت گسترده‌تری پیش‌بینی کرده، اما با چالش‌های اجرایی مواجه است، در حالی که آمریکا با وجود چهارچوب‌های روشن‌تر در رضایت آگاهانه، به دلیل نبود نظام جبران یکپارچه و بیمه اجباری، حمایت عملی محدودتری ارائه می‌کند.</div> <div style="text-align: justify;">Background and Aim: Medical research involving human subjects, despite its essential role in advancing knowledge, is inherently associated with physical, psychological, financial and reputational risks to participants. Human research centers, as primary actors in the design, implementation and oversight of such studies, bear special civil liability for preventing and compensating harm. This article adopts a comparative approach to examine the nature, foundations and mechanisms of civil liability of such centers in the legal systems of Iran and the United States, aiming to clarify differences, similarities and practical challenges in compensating damages. Method: This qualitative research employs a descriptive-analytical approach based on documentary and library sources in Iranian and America's Law. Ethical Considerations: In the present study, the principles of integrity, honesty, impartiality and originality have been observed. Results: Effective protection of research participants requires mandatory insurance and a unified compensation system in the United States, and in Iran, the strengthening of enforcement mechanisms and the adoption of risk-based compensation. Conclusion: A comparative review shows that although both Iran and the United States largely base the civil liability of human research centers on the fault theory, their practical approaches and levels of protection differ. Iran’s legal texts and ethical guidelines provide broader provisions for compensating harm, but face implementation challenges, while the United States, despite having clearer frameworks for informed consent, offers more limited practical protection due to the absence of a unified compensation system and mandatory insurance.
