fa مسئولیت فنی معدن‌کاران با کاربری دارویی در قراردادهای جدید وزارت صمت Technical Responsibilities of Miners with Pharmaceutical Use in New Contracts of the Ministry of Health پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: سرمایه‌گذاری در تولید دارو فاقد توجیه اقتصادی بوده و واردات دارو نیز به سبب هزینه بالا و فقدان تأمین استاندارد کافی با چالش‌هایی همراه است. به سفارش وزارت بهداشت، وزارت صمت مدل جدیدی از قراردادهای واگذاری معادن با کاربری دارویی تهیه نمود که ضمن اعطای برخی امتیازات به معدن‌کار، وی ملزم به راه‌اندازی هلدینگ تولید دارو با استانداردهای نهایی وزارت بهداشت خواهد بود. در این پژوهش مسئولیت‌های فنی معدن‌کاران این حوزه مورد مطالعه قرار گرفته است. روش: این پژوهش به روش تحلیلی ـ توصیفی انجام‌ شده و سعی در تحلیل حقوقی قرارداد جدید وزارت صمت می‌باشد. ملاحظات اخلاقی: در تمامی مراحل نگارش، مطابق با اصول تحقیق عمل گردید. یافته‌ها: ذات و ماهیت کانی‌های دارویی چنین ایجاب کرده که فرآوری آن مستقیماً در داخل کشور انجام شود، چراکه صادرات مواد خام مذکور موجب تولد بسترهای فسادزا و از دست‌رفتن ثروت ملی و نیازمندی به واردات دارو می‌گردد. بنابراین پیشنهاد شده که در قبال راه‌اندازی هلدینگ فرآوری، امتیازاتی نظیر تعهد به پیمانکاری نگهداری پس از پایان دوره بهره‌برداری اعطا گردد. این حقوق و تعهدات بی‌سابقه، نمی‌تواند برخلاف قواعد آمره علم حقوق باشد، لذا این نوع قراردادها در شمول عقود غیر معین و صحیح قرار دارد. نتیجه‌گیری: نظارت تک‌مرحله‌ای وزارت بهداشت بر داروی تولیدی فاقد کفایت لازم بر شناخت ترکیبات مولکولی و قدرت هضم و میزان واکنش‌پذیری آن است، لذا نیاز است که نظارت در سه مرحله ثبت معدن، استخراج مواد و تولید نهایی دارو انجام شود و این مهم در فرم قراردادی لحاظ گردد. در این صورت ضمن ممانعت از هدررفت سرمایه، مسائل جانبی دارو قابل ‌شناسایی بوده و می‌تواند دغدغه‌های عمومی این حوزه را تأمین نماید.</div> <div style="text-align: justify;">Background and Aim: Investment in drug production lacks economic justification and drug import is also associated with challenges due to high costs and lack of adequate standards. At the request of the Ministry of Health, the Ministry of Health prepared a new model of contracts for the transfer of mines with medicinal use, which, in addition to granting some privileges to the miner, will be required to set up a holding company for the production of medicines with the final standards of the Ministry of Health. In this study, the technical responsibilities of miners in this field have been studied. Method: This research was conducted using an analytical-descriptive method and attempted to legally analyze the new contract of the Ministry of Health. Ethical Considerations: In all stages of writing, the research principles were followed. Results: The nature and essence of medicinal minerals require that their processing be carried out directly within the country, because the export of the aforementioned raw materials creates corruption, loss of national wealth and the need to import medicines. Therefore, it is proposed that privileges such as a commitment to a maintenance contractor after the end of the exploitation period be granted in return for setting up a processing holding. These unprecedented rights and obligations cannot be contrary to the mandatory rules of law and therefore these types of contracts are included in indefinite and correct contracts. Conclusion: The Ministry of Health's single-stage supervision of manufactured medicines lacks the necessary competence to identify molecular compounds, digestibility, and reactivity. Therefore, it is necessary to carry out supervision in three stages: mine registration, material extraction and final production of the medicine and this important matter should be included in the contract form. In this case, while preventing capital waste, side effects of the medicine can be identified and can meet the general concerns of this field.
