fa چالش‌های حقوقی به کارگیری هوش مصنوعی در پیشگیری و مقابله با خشونت خانگی Legal Challenges of Using Artificial Intelligence in the Prevention and Combating of Domestic Violence پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: خشونت خانگی یکی از معضلات جدی جوامع بشری است که بحران‌های اجتماعی مانند همه‌گیری کووید-۱۹ آن را تشدید کرده و به ‌ویژه زنان را تحت تأثیر قرار داده است. پیشرفت‌های فناوری هوش مصنوعی فرصت‌ها و چالش‌های جدیدی برای مقابله با خشونت خانگی ایجاد کرده است. این پژوهش با هدف تحلیل حقوقی چالش‌ها و محدودیت‌های کاربرد هوش مصنوعی در پیشگیری، کشف و مقابله با خشونت خانگی انجام شده است. روش: پژوهش حاضر رویکرد توصیفی ـ تحلیلی دارد و با استفاده از مطالعه قوانین، اصول حقوق بشر و اسناد بین‌المللی، چالش‌های حقوقی هوش مصنوعی بر فرآیند مقابله با خشونت خانگی بررسی شده است. ملاحظات اخلاقی: در تمامی مراحل نگارش صداقت و امانتداری رعایت شده است. یافته‌ها: استفاده از هوش مصنوعی در حوزه خشونت خانگی با چالش‌های حقوقی مهمی، از جمله حفظ حریم خصوصی، کرامت انسانی، اصل برائت، قانونی‌بودن جرم و مجازات، محدودیت‌های دسترسی به داده‌ها و احتمال سوگیری الگوریتم‌ها مواجه است. همچنین هنجارهای فرهنگی و ساختارهای قانونی جوامع بر میزان اثربخشی راهکارهای مبتنی بر AI تأثیرگذار هستند. نتیجه‌گیری: بهره‌برداری مؤثر و اخلاقی از ظرفیت هوش مصنوعی مستلزم ایجاد سازوکارهای قانونی و اخلاقی، سرمایه‌گذاری در آموزش متخصصان و توسعه بسترهای امن تبادل اطلاعات است. چنین رویکردی می‌تواند به پیشگیری و مقابله مؤثر با خشونت خانگی کمک کند.  </div> <div style="text-align: justify;">Background and Aim: Domestic violence is one of the serious problems in human societies and social crises such as the COVID-19 pandemic have intensified it, particularly affecting women. Advances in artificial intelligence technology have created new opportunities and challenges for addressing domestic violence. This research was conducted with the aim of legally analyzing the challenges and limitations of applying artificial intelligence in the prevention, detection and response to domestic violence. Method: This study uses a descriptive-analytical approach and, through a review of laws, human rights principles and international documents, examines the legal challenges of artificial intelligence in the process of addressing domestic violence. Ethical Considerations: Honesty and trustworthiness have been observed in all stages of writing. Results: The use of artificial intelligence in the field of domestic violence faces significant legal challenges, including preserving privacy, human dignity, the presumption of innocence, legality of offenses and penalties, limitations on data access and the potential for algorithmic bias. Cultural norms and societies' legal structures also affect the effectiveness of AI-based solutions. Conclusion: Effective and ethical use of AI capacity requires establishing legal and ethical frameworks, investing in training specialists and developing secure platforms for information exchange.
