fa حکمرانی اخلاقی و حقوقی داده‌های زیستی در هوش مصنوعی سلامت: تحلیل مدل سه‌سطحی اعتماد، امانت و رضایت Ethical Governance and Biolegal Rights in Artificial Intelligence: Analysis of the Three-Level Model of Trust, Trustworthiness and Consent پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: تحول بی‌سابقه فناوری هوش مصنوعی در پزشکی و ژنومیک، مفهوم «داده زیستی» را از ماده فنی به محور فلسفه اخلاق و حقوق تبدیل کرده است. در این میان، ضرورت بازتعریف رابطه انسان، داده و قانون، از دیدگاه اخلاق زیست‌فناورانه و فقه اسلامی آشکار است. پژوهش حاضر با هدف تبیین چهارچوب سه‌سطحی «اعتماد، امانت و رضایت» و بررسی رعایت این اصول در نظام سلامت ایران انجام شده است. روش: این پژوهش بر پایه روش تحلیلی ـ تطبیقی انجام شده است. داده‌ها در سه حوزه فلسفه اخلاق، فقه اسلامی و حقوق بین‌الملل گردآوری و با یکدیگر مقایسه شدند. تحلیل‌ها به صورت کیفی، در سطوح نظری و مقرراتی، انجام گرفت و الگوی ملی اخلاق داده از دل مقایسه نظام ایران، اتحادیه اروپا و جهان عرب استخراج شد. ملاحظات اخلاقی: در پژوهش حاضر جنبه‌های اخلاقی، شامل اصالت متون، صداقت و امانتداری رعایت شده است. یافته‌ها: نتایج نشان داد اصول اعتماد، امانت و رضایت بنیان‌های هم‌پوشان میان فقه اسلامی، فلسفه اطلاعات و مقررات بین‌المللی حفاظت از داده‌اند. اعتماد، پایه پاسخگویی و شفافیت است؛ امانت، بیانگر مسئولیت اخلاقی در حفظ کرامت انسانی و رضایت، محور مشروعیت حقوقی تصرف در داده‌ها. همچنین قانون سلامت دیجیتال ایران نخستین چهارچوبی است که این سه اصل را در قالب مقرره‌های ملی تلفیق کرده است. نتیجه‌گیری: اخلاق داده نه در قالب مالکیت فناورانه، بلکه در قالب امانت انسانی معنا می‌یابد. مدل سه‌سطحی این مقاله می‌تواند راهنمای سیاستگذاری برای صیانت از کرامت داده و تقویت اعتماد عمومی در نظام سلامت ایرانی و بین‌المللی باشد.  </div> <div style="text-align: justify;">Background and Aim: The unprecedented development of artificial intelligence in medicine and genomics has transformed biodata from a technical component into a central subject of ethics and law. This transformation highlights the necessity of redefining the relationship between human beings, data and legal regulation from the perspectives of bioethics and Islamic jurisprudence. This study aims to conceptualize a three-level framework of “trust, fiduciary responsibility (amanah) and consent” and to examine their reflection in Iran’s health system. Method: This research employs an analytical-comparative approach. Ethical philosophies, Islamic jurisprudential sources and international legal instruments were collected and comparatively analyzed. Qualitative analysis was conducted at both theoretical and regulatory levels and a national model of data ethics was extracted through comparison among Iran, the European Union and Arab legal systems. Ethical Considerations: In this study, ethical principles of library-based research, including originality of sources, academic honesty and scholarly trustworthiness, were fully observed. Results: The findings indicate that the principles of trust, fiduciary responsibility and consent represent shared foundations among Islamic jurisprudence, information ethics and international data protection regulations. Trust constitutes the basis of accountability and transparency; fiduciary responsibility reflects ethical commitment to human dignity; and consent provides legal legitimacy for data processing. Iran’s Digital Health Law demonstrates an initial integration of these principles at the national level. Conclusion: Data ethics cannot be reduced to technological ownership but should be understood within the framework of human trust and fiduciary responsibility. The proposed three-level model can serve as a conceptual guide for protecting data dignity and strengthening public trust in national and international health systems.
