fa خودکشی مساعدت شده پزشکی: از مبانی جرم انگاری تا واکنش کیفری Physician Assisted Suicide: From Foundations of Criminalization to Penal Reaction پژوهشي Original Article <p>یکی از موضوعات مهم و بحث برانگیز در حوزه حقوق پزشکی، بحث «خودکشی مساعدت شده پزشکی» می‌باشد که طی یکی دو دهه اخیر در میان حقوقدانان، جرم‌شناسان، پزشکان و حتی خود بیماران به عنوان بخشی از جمعیت آسیب‌پذیر جامعه، موضوعی مشاجره آمیز بوده و موافقان و مخالفانی داشته است. مرکز ثقل این مشاجرات، موضوع «حق انتخاب مرگ» برای بیماران می‌باشد. از منظر آموزه‌های حقوق کیفری، میان اتانازی و عنوان مذکور، از حیث «مباشرت» یا «معاونت» کردن پزشک در مرگ بیمار، تفاوت چشمگیری وجود دارد؛ بدین معنا که پزشک، در اتانازی «مباشرت» و در خودکشی مساعدت شده پزشکی «معاونت» در مرگ بیمار می‌نماید. به دیگر سخن، در عنوان نخست، عامل مرگ «پزشک» و در عنوان دوم، عامل مرگ خود «بیمار» است. در سیاست جنایی ایران، خودکشی اگرچه تحت تأثیر آموزه‌های دینی و فقهی مباح نبوده، لکن مورد جرم‌انگاری قرار نگرفته است و به تبع نظام استعاره مجرمیت - که در اغلب نظام‌های حقوقی من‌جمله ایران پذیرفته شده است- معاونت در خودکشی نیز جرم و قابل مجازات نمی‌باشد. مع‌الوصف قانون‌گذار ایران، در ماده 743 قانون تعزیرات (ماده 15 قانون جرایم رایانه‌ای) مصوب 1388/3/5، برخی از اقدامات یاری دهنده و تسهیل کننده خودکشی از طریق سامانه‌های رایانه‌ای، مخابراتی یا حامل‌های داده را، به عنوان جرمی مستقل، جرم‌انگاری نموده است. این نوشتار، از یک سو مبانی جرم‌انگاری موضوع حاضر را مورد نقد و واکاوی قرار داده و از سوی دیگر، به شیوه‌های واکنش کیفری نظام حقوقی ایران در مواجهه با این مسأله پرداخته است؛ و در نهایت، در راستای تکریم حیات انسانی و پیشگیری از پدیده انحرافی خودکشی، پیشنهاد جرم انگاری «خودکشی مساعدت شده پزشکی» را، به عنوان جرمی خاص و مستقل، ارائه نموده است.</p> <p>One of the most important and controversial issues in medical law is “Physician Assisted Suicide” that during the recent decades, it has been a challenging issue among the jurists, criminologists, doctors and even the patients themselves, as a part of the vulnerable population of society. This subject has had its own supporters and opponents. Core of these disputes is the “Right to Die” for the patients. From the perspective of criminal law doctrines, there is a significant difference between the Euthanasia and the above mentioned subject, from the view of doctor’s direct or indirect participation in the patient’s death which means that doctor is involved in euthanasia directly and provides assistance in the physician assisted suicide. In other words, in direct participation, “doctor” does the actus reus of murder, but in indirect participation, she only helps the “patient” to kill himself. In criminal policy of Iran, suicide is not permissible under the influence of religious and juridical doctrines, but has not been criminalized, and therefore it concluded that assistance in suicide should not be considered criminal. Nevertheless, the legislator of Iran has criminalized aiding and facilitating suicide through the computer systems, telecommunication systems or data carriers, as an independent crime.
