fa تاثیر پس‌زدن عضو پیوندی بر عمل حقوقی انتقال عضو مروری Review Article <div align="justify" style="direction: rtl">اصولاً هر عمل پیوند عضو، مستلزم انعکاس اراده طرفین در قالب یک عمل حقوقی است؛ این عمل حقوقی، توافقی خصوصی است که قبل از پیوند بین دهنده و گیرنده راجع به انتقال عضو صورت می‌گیرد و هدف اصلی و اساسی طرفین از انعقاد چنین قراردادی، حفظ سلامت و بهبودی گیرنده عضو پیوندی می‌باشد. با وقوع پدیده &laquo;پراندن&raquo; یا &laquo;پس‌زدن عضو پیوندی&raquo; هدف نهایی طرفین از انتقال عضو بنا به دلائلی محقق نمی‌گردد. در صورت پس‌زدن عضو پیوندی، به خصوص در رابطه بین دهنده و گیرنده زنده، ممکن است گفته شود که به علت اشتباه در وصف اساسی مورد معامله که همان &laquo;قابلیت پیوند به شخص گیرنده معین&raquo; می‌باشد، بطلان عمل حقوقی صورت گرفته، کشف می‌شود. و یا اینکه با توجه به وجود &laquo;شرط فاسخ ضمنی&raquo;،که برخاسته از تعهد همراه با حصول نتیجه مندرج در ضمیر طرفین، است عقد واقع شده منفسخ می‌شود و یا به لحاظ عدم حصول نتیجه مورد نظر برای گیرنده حق فسخ و مطالبه خسارت شکل می‌گیرد. در صورت &laquo;پس‌زدن&raquo; عضو پیوندی، باید با توجه به اصول کلی حقوقی در هر مورد بنا به شرایط حاکم بر قرارداد و نیز شروط مندرج در آن تعیین تکلیف نمود و چه بسا عقد مذکور با توجه به ضرورت و لزوم حصول نتیجه و شرایط خاص توافق فیمابین باطل یا منفسخ شده و یا قابلیت فسخ پیدا کند. در صورت سکوت قرارداد، هیچ کدام از ضمانت اجراهای ذکر شده را به عنوان قاعده نمی‌توان پذیرفت و باید اصل صحت و لزوم قرارداد را با توجه به ماهیت ویژه قرارداد و این تفسیر که تعهد دهنده عضو با جداسازی عضو پیوندی از بدن وی، اجرا شده است، بر عمل حقوقی مزبور حاکم دانست.</div> <div align="justify">Generally any act of organ transplantation requires that reflect the will of the parties in a legal action format.
