fa نظم عمومی و حقوق مالکیت ادبی و هنری مروری Review Article <div align="justify" style="direction: rtl">حقوق مالکیت ادبی و هنری به دلیل ارتباط گستردهای که با طبع هنرمند و خلاق انسان دارد، یکی از نیازهای طبیعی و یک ضرورت اجتماعی بدون جایگزین برای زندگی بشری محسوب میشود. زندگی اجتماعی و نیاز به تولید و داد و ستد محصولات و مصنوعات هنری و ادبی، انسانها را به برقراری روابط اجتماعی، سیاسی و فرهنگی سوق میدهد. در این زمینه دولتها به عنوان نماینده ملتها برای برقراری و حفظ این رابطه نیازمند ایجاد قواعدی برای حسن اداره امور، تنظیم روابط اجتماعی، تعیین و اعلام حقوق و تکالیف آنان و سرانجام صیانت از حقوق و آزادیهای فردی و نظم عمومی میباشند. از مهمترین وظایفی که بر عهده دولتها گزارده شده است؛ تنظیم و توازن این حقوق و آزادیها و حفظ عناصر کلیدی حیات اجتماعی همچون نظم، امنیت، آرامش، سلامتی و نفع عامه است. جانبداری بیرویه دولتها از هریک از این عناصر یا حقوق میتواند به تضییع حقوق افراد یا متزلزلنمودن پایههای حیاتی یک حکومت بیانجامد. از این رو تبیین هریک از این حقوق و تضمین آنها و در مقابل، ارائه تعریف مشخص از مقولههای تضمینگر زندگی اجتماعی از جمله نظم عمومی و نفع عمومی میتواند چارهای بر رفع چالشهای پیش روی دولتها باشد.</div> <div align="justify">Copyright because of its extensive relationship with the artist and the creative human nature is one of the natural needs and a social necessity no substitute for human life. The social life and exchange of artistic and literary products leads people to make social, political and cultural relationships. In this field, the states as representative of nations, for establishing and maintaining of this relationship, need to make rules for the proper administration, the regulation of social relations, determination and declaration of their rights and duties and, finally, protection of the rights and individual freedoms and the public order. One of the most important tasks that have been undertaken by the government is the regulation and the balance of these rights and freedoms and the protection of key elements of social life such as discipline, security, peace, health and public interest. States excessive favoritism of each of this elements or rights may lead to violation of the rights of individuals or shaking the foundations of the vital life of a government.
