fa دعوا و معیارهای نقض حق تکثیر پدیدآورنده مروری Review Article <div align="justify" style="direction: rtl">حمایت از حقوق انحصاری پدیدآورندگان آثار وقتی عینیت و تبلور مییابد که تدابیر لازم برای حمایت از آنها و آثارشان پیش بینی شده باشد. در قوانین ایران ضمانت اجراهای کیفری و مدنی نسبتاً مناسبی برای نقض این حقوق پیش بینی شده است. اینکه ضمانت اجراها مؤثر و کارآمد هستند، مقوله مهمی است، ولی رسیدن به چنین نتایج و ایجاد تضمین کافی برای پدیدآورنده به فراهم کردن یا شدن بستر دادرسی عادلانه وابسته است. دادرسی دعاوی حقوق مؤلف در ایران کمتر مورد توجه قرار میگیرد. از این رو شاید پرسش اساسی این باشد که در دعوای نقض حقوق مالی، وظایف اشخاص درگیر و طرف دعوا و محکمه رسیدگی کننده به اختلاف چیست؟ پاسخ به این سؤال موضوع این تحقیق است.</div> <div align="justify">The results and Effects to protect the exclusive rights of authors only appears when the necessary measures to protect them and their work is anticipated.
