fa دکترین سوء استفاده از حق در مالکیت ادبی و هنری مروری Review Article <div align="justify" style="direction: rtl">دکترین سوء استفاده از حق در حقوق مالکیت ادبی و هنری بر قاعده عدل و انصاف و دکترین دست‌های آلوده بنا شده است. دست‌های آلوده، دارنده حق را از دریافت خسارت غیر منصفانه به دلیل عملکرد نادرست و مبتنی بر سوء نیت منع می‌کند. به عنوان مثال می‌توان دارنده حقی را که در حوزه مالکیت ادبی و هنری به اقدامات شبه ضدرقابتی دست می‌زند را به وسیله اعمال این دکترین، از تعدّی از اختیاراتش که فراتر از قلمرو حق قانونی اعطا شده به اوست منع کنیم. سوء استفاده از حق در حوزه مالکیت ادبی و هنری برخلاف حوزه حق اختراع از عمر چندان طولانی برخوردار نیست و از اوایل قرن بیستم در دادگاه‌ها مطرح شده است.<br> نکته قابل توجه این است که سوء استفاده از حق، از استثنائات حق انحصاری اعطایی به دارنده حق در حوزه حقوق مالکیت ادبی هنری بوده و به عنوان دفاع مؤثر، در دعاوی دارنده حق علیه ناقض محسوب می‌شود. اهمیت توجه به این نظریه از آنجا ناشی می‌شود که با اعمال محدودیت‌هایی برای دارنده حق با استناد به بند 2 ماده 8 موافقت‌نامه تریپس به رشد هرچه بیشتر دانش و انتقال بین‌المللی آثار ادبی و هنری کمک شایانی خواهیم کرد.<br> همچنین در حوزه حقوق اسلامی که منشأ و منبع اصلی حقوق در ایران است نیز مدت‌ها پیش از حقوق غرب، قاعده جامع و فراگیر &laquo;لاضرر و لاضرار فی الاسلام&raquo; مطرح شده و به جرأت می‌توان سوء استفاده از حق را به ‌عنوان یکی از کارکرد اصلی این قاعده در نظر گرفت.<br> در این مقاله سعی بر آن است که ضمن شناسایی مبنا و کارکرد دکترین سوء استفاده از حق در مالکیت ادبی و هنری، جایگاه آن در نظام حقوق مالکیت ادبی و هنری ایران تحلیل شود.</div> <div align="justify">The abuse of right doctrine is based on the Equity Rule and the doctrine of Dirty hands. Dirty hands prohibit the owner of right from receiving unfair loss because of incorrect operation based on bad faith. For example, the owner of right who use quasi anticompetitive proceedings in Literary and artistic property domain, can be prohibited from abusing his authorities by operating this doctrine. Unlike in the invention scope, abuse of right in Literary and artistic property domain doesn&#39;t have a long age and is considered in courts from the beginnings of twentieth century.<br> The significant point is that the abuse of right is an exclusion of Monopoly right granted to the owner in Literary and artistic property domain and is an effective defense in the claims of the owner against the adversative.
